5 Years Cap rule. Urgent Help, Entrapeneur refused

Basically my Entrapeneur visa was refused with all the appeal rights exhausted. My PSW visa was expired in oct 2012.
My question is, Can i apply for student visa with 28 days rule
IF SO
will 5 years cap rule apply on me. as i came on student visa in 2006 till 2010

How many visas you been issued and for which level/courses and what you studied so far?

Student Visa issue september 2006 till october 2010 ( 4 years 2 month)
PSW issue October 2010 till october 2012
Entrapeneur applied in october 2012
UTT refusal came in june 2014

Actual study period was september 2007-november 2008 (BBA honours coventry university)

Now i want to apply for student visa again but worried about 5 years cap and any other complications

For which course first visa was issued for in 2006?

What did you study from Sep 2006 - Sep 2007? and after Nov 2008 till your psw visa.?

Need to know all study period and level to calculate the cap.

5 year CAP is not just 5 years of student visa

% years means 5 years of study time.Count all courses start date till end date time and see if it crosses 5 years.
And if theres any qualification at level 5 or below that will not count towards 5 year CAP.

I came on student visa in sep 2006 for BBA. But because it was not a good college and i thought i am wasting my money and time, i did not complete the degree and next year sep 2007i took admission in university who gave me direct entry into third year of BBA honours. and in one year november 2008 i completed my BBA. then 2 years nov 2008-oct 2010 i did not study again as i finished my degree already

Count all your courses from start to end date
Course start date 10/02/2010
Course end date 10/02/2011
But visa Expires 10/06/2011

Your time count towards 5 yr cap will be counted as 12 months not 16 months

Could bring this question that why didnt I did not study
In rest of my visa. As my degree finished 2 years earlier

Actually I also want to know if there is any way to find out which level study is actually showing to UKBA records, as I have landed in uk in year 2005, on MSc course than because college was changed I took admission on the same year in diploma, now I have heard that it all depend upon what past record actually shows.

Can anybody give a light on this information and help me out, that would be much appreciated.

Also I want to know, if my visa get refused(have appeal decision pending of entrepreneur) and if I am given time of 28days for new application, is there any institution or uni that will be able to enrol me on level 8?

You may be still have a one year left for your 5 years cap, and may be you can get admission to one of the Uni or HTS college but there is a huge possibility your visa will be refused after UKVI do the credibility interview. They are asking the students to attend the interview now a days and they will definitely wants to know after finishing your course early what you did at that time? Why you did not complete your Postgrad at that time?

So be prepare for that
