Switching from Tier 2 General to Tier 4

Post by Jack&Jill » Wed Jul 13, 2016 3:16 pm

Dear Experts,

I came to UK for Masters Degree on September 2009.
Completed Studies on December 2010.
Got Post Study Work(PSW) Visa on April 2011.
PSW Visa expired on May 2013.
Tier 2 General Visa since June 2013.
As of 3 Years now I'm on Tier 2 General Visa. I'm planning to do MBA now, September intake.

My present employer's finance situation is very poor, and so he may close the company anytime now. So far the company license is valid and he is planning to inform HO by end on this month.

My question is can I change my visa from Tier 2 General to Tier 4 General?
If so do I need to apply Tier 4 before I get 60 days letter from HO?
What happens if I apply Tier 4 after I get 60 days letter from HO?
Is there any chance HO ask me questions?

if the college or uni is ready is to give u a CAS, then u will be fine.
If it is a college rather than a uni, u will find it difficult that college give CAS to people with already a masters degree.

Its a Uni.

My question is, is that mandatory to change to Tier 4 before license revoke?
Will it be a problem changing after I get 60 days letter from HO?

Thanks
Jack

No, but you must apply before your curtailment end date

The issue is unlikely to be the curtailment letter as that will take sometime to arrive.

The single biggest issue will be convincing a Uni to give you a COS given there is no progression of studies and you are moving from employment.

The other issue will be the HO, they will almost certainly interview you if you apply for tier 4. Your immigration history points them in a direction that would suggest your studies are to facilitate remaining in the UK rather than for educational reasons.

Long road in front of you, not impossible but expect the worst and hope for the best.
