Switching from Tier 2 ICT to Tier 4 dependent

Post by jandh » Sun Aug 14, 2016 3:15 pm

Hi,

I need your valuable suggestion and advice

I'm in UK for last 4.7 years on Tier 2 ICT Long Term visa.We have to leave UK in 2017 January as I will be completing 5 years on ICT. My wife would like to do her masters here in UK. Could you please help on the below clarifications?

1. Can she switch from Tier 2 dependent to Tier 4 student visa within UK?
2. Can I switch to Tier 4 dependent from Tier 2 ICT without cooling off period? If yes can I switch while within UK?
3. Can I switch to Tier 2 General once I finish 1 year on Tier 4 dependent?

Thanks,

1. No, she has to apply from home country. See Switching to Tier 4 (click)

2. Yes, if she gets a visa and returns, you can switch to Tier 4 dependent within the UK. Cooling off period does not apply if you switch to PBS dependent visa.

3. Yes, but you can't 'switch'. You have to apply from your home country and it must be a full 12 months from the date of your Tier 4 dep start date.

to the the 3rd question, what if the tier 4 dependent has a CoS from an employer, will he be able to switch to Tier 2 general from Tier 4 dependent while within UK?

Hello mate, just wanted to check if you went ahead with the option of applying for a tier 4 visa for your wife?

This thread is 6 months old and the OP only posted twice and hasn't visited the forum since December 2016
