T4 student to T2 work permit

Post by calvinwin » Tue Sep 16, 2014 6:16 pm

Hi all, just wondering if your guys could help me with this issue, I have read through home office web about how T4 can be transfer to T2, it states like below:
Switch from a Tier 4 or other student visa
You must have got 1 of these qualifications from your student visa if you want to switch from a Tier 4 to a Tier 2 (General) visa:

a UK bachelors degree
a UK masters degree
a postgraduate certificate in education
a professional graduate diploma of education
The other student visa categories are:

student
student nurse
student re-sitting an examination
overseas qualified nurse
person writing up a thesis
postgraduate doctor or dentist
student union sabbatical officer

It does states that T4 student can be switched to T2, However when I contact to some agents and solicitor they all said without a proper degree, we can't switch to T2.

I didn't do any degree in UK, the only one I have done is ACCA, and I have passed them all, I am really confuse about this, is my ACCA degree and apply for T2 or not?

Thank you guys

Do not rely on Agencies, most of them are badly ripping off the Tier 4 students and PSW holders. Either they will disappear in middle of the road or they will file your application which will get rarely successful. Be careful.

ACCA.Is not a UK degree so you do not qualify to move to tier 2 in country. You can apply outside the UK on a restricted COS

Thank you for your replied, but just wondering the UKBA does say student can apply for a T2 visa isn't it? Having say applying for outside of the country, what kind of criteria do I need to meet, or the employer need to meet please.

Once again, thank you

You need to hold a UK degree awarded in a continuous period of leave in the UK to go from T4 to T2 in country.
The job must be at NQF6 and above for you to qualify.
Obviously the employer has to hold a T2 licence.

You also need to pass RLMT unless your job is exempted for this.

I have ACCA qualification, isn't it above NQF6 level? As far as I know it is more higher.

ACCA is a professional qualification and not a degree. The rule states degree so degree it is, not a NQF 6 or above.

Dont mix 2 things together.

He is a student so he needs a degree Bachelor or Masters to switch to Tier 2.

2nd thing Job should be NQF level 6 or above but doesn't mean that the person should hold NQF Level 6 Qualification as well. This is for people who r switching from teir 4 depedant and people applying from outside UK.

Resident Labour Market Test, that's inferring this particular skill/job couldn't be found in the resident labour market.

Thank you very much for your explanation, just another question, so what shall I do if my boss want to hire me and help me with my visa, shall I need to go back to my own country and apply for T2 again?
