Urgent Inquiry! 5 year cap

I am a little confused with the 5 year cap for tier 4 students

There is a 5 year cap on degree level and above (NQF level 6 and above) and 3 year cap on below degree level (below NQF 6)

My scenario :

Did my Foundation Diploma NQF level 4 in 2010 (classified as below degree level)

As i obtained 71% i was given direct entry in BA (HONS) 2nd year (NQF level 6) i did that two years (2011-2013) . After this i progressed to MSc (NQF level 7)

I now plan to do MBA for two years including 12 months for internship.

Would i be granted a leave as i have spent 3 years doing degrees which were at NQF level 6 and above? As i did my Foundation Diploma at NQF level 4 will that be classified as below degree level as it is below NQF level 6?
