HI Guys!

What is the current waiting time ( of getting the passport back)if you are withdrawing a tier 4 extension application?

on UKVI's website they say within 10 Days , but is there anybody who is facing delays or any problems due to ETS - TOEIC Certificate?

I applied in Feb 2014, and still waiting for the response from Home Office, Even though i've contacted my Local MP , even to MP they are giving the same story that its under consideration, so finally i am planning to withdraw and go back to my country as i need to travel in 1st week of November.

Any advice or tips?

hi
m in the same boat as u my friend.i have applied in April 2014 with toiec but after i did ielts as well and still waiting for HO response.i want to withdraw my application and go back to my country.now m going to fill online form and i will call them as well to withdraw my application and i will send them letter as well,then will c what is gonna happen.

If you applied using ETS and have not yet had a responce then you will NOT get your documents back. You can get them back once you have supplied derails of your return flight and you will be given your passport once you have checked in and are going through security to air side.

so will they just give documents back or they will charge any criminal offence ?

The worst they can do is give you a refusal letter and a ban from re-entry for a maximum of ten years.
You are not a criminal because you are caught up in the ETS issue. So no arrests at the airport. There is no benefit in detaining you just to remove you at some point later. They will happily wish you well as long as you get on the plane.

this is the issue if they just give documents back thats ok but ten year ban is not acceptable even toiec is expired now

It is each individual's choice as to what they do. Wait and be arrested in country, dragged out of your bed at 5 in the morning to receive your refusal when you get arrested, driven off with whatever you can gather in a few minutes and then spend a minimum of three days in a detention centre then get removed. The ban will still be ten years for use of deception.

Contact UKVI having put your affairs in order.
Got a ticket to where you want to go at a time you want to leave. Get yourself down to the airport in your own time. No escorts pushing you through the airport or being treated like some big time criminal. You check in by yourself, minimum fuss like a normal passenger. No escort to the plane and just a little chat with someone after security to pick up your documents.
You can't avoid the ban by going voluntarily as the deception employed is a fact of the matter.
You might and I stress might have a better chance of arguing that the ban should not apply as you have withdrawn the application. But don't be surprised if it is still imposed because you can't escape the issue of a false test result.

You might not like the ban but if it applies it applies and you are not going to get a court to see otherwise. JR's on the refusal and ban are being thrown out time after time.
You will not find one successful appeal post on this site in relation to ETS refusals. You will see many posts about people being arrested and removed.

For anyone thinking about their options - better to make your own choices rather than someone else making them for you.

also Is there any limit of days i need to allow home office to arrange my passport at Heathrow ? or they will have ready if i book the ticket and give them a proof of my ticket booked in couple of days?

I would like to say they are efficient and can sort it out in a couple of days. They can't!
I would suggest a minimum of two weeks before you fly is a safe bet to ensure your documents are at the airport. Anything less than a week is going to stretch them and there is a real danger you will not get the documents before you fly. There is no central point for documents, most will be in Sheffield but regardless of where they are being held they have to be trasfered to a removal & returns unit at whatever airport your departing from. They are the team that ensure you get your docs at the airport.

When it has been confirmed that they will give the docs at the airport make sure you receive a letter / email that tells the airline you can check in without a passport. The exception to that is that your docs will be returned to you at the check-in point.

I have heard of a couple of times where they have actually sent the documents back to the individual directly rather than collect at the airport. It is very rare but make sure your current address is on the contact email AND confirm that documents are NOT to be sent to your legal reps.
