Tier 2 (General) to Tier 5 (YMS); Need to consider husband

Post by natalie1139 » Tue Dec 06, 2016 12:45 pm

Hi,

My situation is quite complex, so any help is appreciated!

Here is my current situation:
- Australian
- Currently on Tier 2 (General) visa
- Would like to switch to Tier 5 Youth Mobility visa for more flexibility in job opportunities (I can travel back to Australia and apply from there)
> How long does it take to cancel my Tier 2 visa? I have read it can take up to 3 months; will i be denied a Tier 5 visa if my Tier 2 is still active?
> My passport only has three blank pages left. I can apply for a new passport under my married name (will this cause any issues with my visa application?)

My husband:
- Australian
- 1 year left on Tier 5 YMS
> Would it be possible for him to become a dependent on my Tier 5 visa once his visa expires?

We're not planning to stay long term; we'd ideally like the option to stay for 6 months after my husband's visa expiry.

Many thanks!

In essence you can switch to T5 YMS but it will make no difference to your husband as he can not be your dependent on a T5 YMS.
So his stay in the U.K. Is limited to his current visa expiry.
Best option is to remain on Tier2 and husband becomes your dependent under that visa. Restricts your working but allows him to carry on as if under T5YMS

Tier 2 (General) to Tier 5 YMS Cooling off period?

Post by natalie1139 » Wed Dec 14, 2016 12:48 pm

Hi,

I am aware that there is a 12 month cooling off period going form a Tier 2 to another Tier 2 visa. Is anyone aware if this cooling off period applies if i want to go home to Australia and apply for a Tier 5 YMS visa?

Many thanks,
Natalie

Not applicable as far as I am aware, it is specific to Tier 2.
