ILR Eligibility for Wife & 2 Kids

Hi Moderators,

are you able to advise on my case which is as follows:

Main applicant (i.e. myself) is ILR holder as of Sep2015.

My Wife and 1 Kid (under 2 years) are in India since Mar 2015 & both their Tier 1 General dependent visas expired in May 2015. 2nd Kid also in India since Aug 2015 and currently applied for Indian Passport.

Q1 - Is it worth applying for ILR dependent visa ? incl NHS Surcharge?

OR

Q2 - Apply all 3 dependents visa once the main applicant obtains British passport by end of 2016?

Q3 - Is NHS surcharge refundable for ILR cases i.e. if applied from outside UK?

The visa category for both ILR holders and British citizens is the same - family of a settled person visa. And IHS is payable for all three applications.

IHS is not payable for ILR applications. But it is payable for ILR dependent visas and there is no refund for that.

Thanks for the update,

One of my friend is main applicant & ILR holder.
Had a new born baby in India and recently applied for ILE for the kid and paid IHS surcharge from India.

On ILE approval, only the IHS amount (around 60k Indian Rupees) for the ILE dependent applicant is refunded to his account.

Did anyone got such refund for ILE dependents ? i.e. is Surcharge refundable for ILE dependent applicants?
