Probationary citizenship

Hi there,

I am on spouse visa but i want to know if during my 5yrs Probationary citizenship period i get separated from my wife will this effect my ILR application?

You mention Probationary Citizenship. This hasn't yet been implemented and is scheduled for July 2011. What visa category do you have at present...and this under UK law or EU regulations?

Casa - I read a bit about the prob citizenship following this post, sorry if my question has been answered previously....

I am on tier 1 now, will be applyng for ILR in June.

Say I get my ILR in JUne, and I want to apply for Citizenship in Aug 2011 - Will I be eligible for citizenship under current rules or will I fall under the new rules?

EDIT: OK I read abit more, this is how I understand it now...

Current tier #1 period is called temp residency...

after completing 5 yrs as temp resi - you become a probabtionary citizen instead of a ILR... then you do some donkey work to earn ILR/citizenship/....

If I get on to ILR before JUly 2011 next year, I will skip the probabtionary citizenship category... And I can apply for passport in the normal way...

Is this understanding correct?

Yes. If you can apply for ILR before July 2011, you will have up to July 2013 to apply for citizenship under current rules.

My understanding is that you will be on your 2 year spouse visa and then go onto Probationary Citizenship. ILR won't exist.

Just need on more information regarding time spent under dependent of tier-1 visa for probitionary citizenship. Do the dependants also need to complete 5 yeas before making application for PC?

In my case I came here on WP in 2006 and later on I changed to Tier-1 in 2008. My wife joined me in one year later (in 2007). Can we both apply for PC in septemeber 2011 after completing my 5years (although my wife will have spent 4 years till that time).

While on spouse visa - if you get separated from your wife, she can inform the UKBA of withdrawal of support. Even if she doesn't - after the two years, you can't go on to the next stage of settlement under this route.

While on Probationary Citizenship - those details haven't been worked out yet. You'll have to wait.

may not be exactly right to say Donkey work, do you mean you dont want to give anything to the community you live in? time to change the perception thou.
