Taking the above into consideration you therefore cannot meet the requirements of Paragraph 276B(1)(a)(b) and (111) of HC395 (as amended)
I had refused to provide specimen because l wasnt driving the car but in charge of it sitting in the passenger side.
If l appeal what kind of evidence are they after?? is there any thing l can do to prove l have been here all this time?????
What about my conviction? will be considered spent mid august.
Appeal deadline end of may.

Thanks Hopeful2, GodGives and glory5050 for your congratulatory messages. The letter came by ordinary Royal mail post. It is the BRP that will be sent under separate cover for which you have to sign for and show a form of identity before you collect it. Goodluck to everyone who is still waiting or has appealed.

My timelines were as follows:
Application sent: 07/07/2012
Acknowledgement letter received: 23/07/2012
Biometric invitation letter received: 26/09/2012
Biometric enrolment done: 08/10/2012
ILR letter of approval along with 3 passports and some other documents received:22/05/2013. (the approval letter was dated 17/05/2013)

I posted my application on 07/07/2012 and received my ILR letter on 22/07/2013 - a total of 10 months 2 weeks!

I have been a silent member of this community for the last 10 months and received the good news today and i thought i have to share it with you guys. I received my documents and card today through my solicitor. Documents and card was sent to my solicitor address rather than to my own address.

my back ground is pretty simple. I was born here and went to school, college and university. and have been working here for the last 16 years but there was a dispute about my British nationality hence i was advised to apply for ILR. Proving my length here was not a problem as alone my work record is sufficient enough for that purpose. I don't have any criminal record, in fact i work very closely with police and was commended for my work by chief superintendent of my local constabulary.

Last 10 months have been very hard on me and i am glad the wait is over and i can continue with my life. I pray for all of you who are still waiting and hope your prayers will be answered soon.

Important info for members waiting for the 14 yrs ILR

Dear members

After what we all have collectively suffered already, I want to do my little bit to reduce further unnecessary suffering for those still waiting for their ILR. If you haven`t done so already, you must be checking the daily mail of the house where you live religiously! This is so because your letter from the UKBA might come and someone who doesn`t know you may either throw it away or write on it "return to sender, doesn`t live here" and post it back! That sort of thing happens in many buildings where there are so many people who don`t know each other. It can also happen where one has recently moved into a premises and nobody knows the person`s name etc.

Also if you have changed your address since your application, try to check for your letters at the old address too. This is despite having changed your address at the UKBA website and having established a mail redirection service with the Royal Mail. The simple reason is that the UKBA has sometimes sent people`s documents to the old address by mistake! Also, despite the redirection of mail service arranged with the post office, sometimes, a few letters slip through and are sent to the old address!

I have to sound a note of warning about the way the various documents are received so that you don`t panic or stress unduly if it doesn`t conform with what you have expected. The common sequence is this:
(1) Letter from UKBA telling you that it was returning your passport(s) and other documents in support of your application and that your BRP will be sent in 7 - 10 days under special cover. It also tells you that your application has been approved and explains to you what to do if your BRP is lost or if you want to travel etc. This letter comes by ordinary post in a big envelope containing your passport(s) and other documents.

(2) Letter from DX courier company for which you to have show an ID with a name which tallies with the name on the letter containing the BRP. You also have to sign to receive it. If you weren`t in or those in the house did not recognise your name because you are a new tenant, the courier will return with your BRP! The BRP has the size of a credit card. It has an important number at the top right corner, bears your name, expiry date, type of permit, remarks, your passport picture and signature. Art the back, it has your date of birth and place and signature. The letter to which your BRP is attached tells you about the importance of the number on your BRP card because it is this number you will use to obtain a replacement if the card is lost or missing. You are therefore advised to photocopy the letter and the BRP card and put them separately in case the original bets missing or lost.

(3) Normally that should have been the end of the matter but if the DX man couldn`t find you, you will soon receive a letter from the DX sent by ordinary post that that they were unable to deliver and ask you to provide a convenient time for you to repeat delivery etc. The above sequence is the normal one. However due to strange reasons bordering upon inefficiency, different patterns have emerged as many people who have received the ILR will testify to. Some people inexplicably received the BRP first before the letter informing them that the ILR had been approved and that the BRP was on the way! Some got the passport(s) and documents first, then after some days, the approval letter separately and lastly the BRP some days much later. Thus from the above, the delivery can be very bizzare. My advice is not to panic but to contact the UKBA following the advice it has in the documents it sent about such problems or in their website.

Finally, I want to thank all the members who kept the forum alive all these years and also vix789, lola56uk and others for their congratulatory messages. I also want to thank those who established the immigrationboards forum and also flashed the news that the UKBA was scrapping the 14 years ILR. That info was vital to me and many others who had to quickly apply before the deadline of 9th July 2012 and so "saved our bacon". Most importantly, I thank God for keeping us alive despite the stressful situations we all have been through. I wont be featuring much ( if at all) in the "leave to remain forum" but will mostly be in the "immigration for family members" forum for obvious reasons. This is because my next drive is to arrange for my partner to come and join me in the UK.
As a parting shot, please, please dear members, even though it wasn`t our chosing/fault to go through the postal route for ILR, try to avoid such situations as much as possible in future. The stress of waiting for about 10 months especially for those of us without any work was unquantifiable and dangerous to anyone`s health and well-being...............it nearly killed me.

I have a feeling that this forum will cease to exist after end of July because I believe that each and every one here would have received a response from the Home Office about their application and all those appealing would have received positive results. I have received my ILR card and my documents.

I made my application all by myself with the help of the information that I had gathered on this thread along. The information posted by Kiwigirl25 is very useful.

The documents I have provided:
1. the passport with all the visas and stamps before I overstayed.
2. three types of bank statements and bills cover every single months when I overstayed my visa.
3. character references from friends and family members.
4. I do have a compassionate reason, with solid evidence from authority. In fact, this is the reason I overstayed, as I had not other options.
5. 5-page covering letter, explaining in details, point by point as to why I should be granted ILR according to the Immigration Rules on Home Office's website.

I am glad the waiting is over. Being an overstayer has taken a toll on me, as overstayer has been hugely discriminated in the society.

I just want to say it out aloud: You never know what has happened in one's life, no one likes to be an overstayer if he/she has a choice. I hope, NOW, I could leave the unfortunate past behind, start everything fresh and have a proper life.

I will still be updating the Application Process List whenever I can until the very last member gets an answer from Home Office, as without the help from this thread, my journey of getting the ILR would have been harder and more costly. http://www.immigrationboards.com/viewto ... 844#819844

The clockstopping (admin Removal) has been smashed by court

Does anyone aware the Alvi case court ruling has lift the spell of clock stopping, this is referring to the issuing of admin removal , which stops the counting for the length of time people staying in this country. Last year , the court had ruled that caseworker can only use the Immigration Rules that had been passed by Parliament, any use of outside this category could be regarded as illegal . the Admin removal is under enforcement section , which is outside the immigration rules. So It will not affect DLR application under longresidency anymore
Anyone has been benefited from this ruling?

Based on this statistics, I believe the Home Office is considering the applications according to the receipt of the Biometric Data. They are processing the applications which have enrolled the Biometric on Oct now.

3. Probably 2/3 or 3 quarters of the 14 years applications have been completed. it may take roughly another 2 months to consider the rest, except selective complex cases.

4. As long as one is be able to provide enough solid evidences to cover all 14 years, given the case is not too complicated, Home Office has to grant the ILR.

Finally, best of luck everyone.

Thanks for your update pgmiot - my biometrics were taken in November although I applied in July so by your observations, I should receive a response either next month or in July - a year after my application? If I remember correctly someone on this forum submitted their biometrics in October and got their ILR in February .....

Anyway whatever happens, we should all receive some kind of response at some point. Until then I recommend that we all try and adopt a positive mental attitude to see us through to the end.

I do not remember that, but, some people could get lucky at times, life has never been fair to everyone.

I think, the applications have been dealt in an orderly manner lately. As long as enough evidences have been provided, receiving ILR is just a matter of time.

I've got it ILR.brp arrived today.will post proper in the morning.gonna have a proper sleep now in 10mnths.just found out at 2300hrs.happy dayz

Thanks all for the help and support for the past months,yu kept me going in the gloom and darkness.special thanks to diggingdeep yu were more than a frend with yo advice when I was homeless hungry and sleeping rough.To those still waiting I'm hopefull you get good news soon and to those not successful yet I hope your appeals will be successful all yu need is faith and belief.
