ILR application date

hi all ,

this is my first question in the forum although i was reading the forum from ages. truely helpful especially when you read the success stories.


my first HSMP clearance : 06-sept 2007
date of first entry : 27 Oct 2007 ( after 51 days)
extension from HSMP to tier 1 till : 06 Sept 2012.

i am planning to apply for ILR in august,2012 mid sometime before 28 days of visa expiry which is sept 06 , 2012.although i heard that I can apply for ILR now in the present rules even when i dont complete the continuous 5 year period, i just want to make sure to plan myself, and can anyone please let me know some success stories.

my confusion is from the ILR faqs in the site :
Q - When does my ILR qualifying period start?
A - There are two scenarios. One is that ILR qualifying visa (e.g. Work Permit, Tier 1, HSMP, etc) was obtained by switching into that category from another visa whilst still in UK. Second is that ILR qualifying visa was obtained out of country. For first case ILR clock starts from the day the passport was stamped with that visa. For second case ILR clock starts from the day when applicant first entered UK on that qualifying visa. E.g. If someone got Tier 1 visa from out of UK on 1st February 2006 and entered the UK for first time on 20th February 2006, then ILR clock starts from 20th February 2006.


and the hsmp guide says :
5 WHEN TO APPLY
You and any dependants applying with you should apply before the end of your/their permitted stay in the UK.
There is a qualifying period to complete in most of the categories on this form. It runs either from
- the date on which you entered the UK with a visa
in the relevant category; or, if you did not enter the
UK with such a visa, from
- the date on which you were first granted permis-
sion to remain in the UK in the relevant category.
If you entered the UK with a visa several weeks or more after the date from which it was valid for use, you may need to apply for an extension of stay to complete the relevant qualifying period.

although the rules dont say that i can apply but it says 'May apply'
can anyone confirm this please?
and also please refer me the thread of some success stories in the recent?

i did a little search in the site and I found a thread which answered my question, but would like to know some success stories recently as this case is quite old ( six months )

btw from the document for guidelines ..it clearly says that date of EC and date of first entry is less than 3 months , then itis not a problem.

Applications that fall short of the five year continuous period
In some cases, applicants may have been granted five years continuous leave, but will not
have spent five years continuously in the UK before their current leave expires.
Caseworkers may count the period between entry clearance being granted and the date the
applicant entered the UK towards the five years, provided this period was not longer than
three months

Delay entry

Hi rajasekhar_you,
I have joined in this forum only few weeks and try to navigate around the forum to find some one had success ILR with similar my situation (my first HSMP entry clearance and date of first entry 36 days delay).
