Good Morning board,

Thank you all for helping us with HSMP application. Application was sent on 6th June, money was take off my VISA card on 8th. Got the Ref number in 3 weeks time. Emailed about the status to new HSMP email address on 12 Octth, got the reply back on 14 Octth, saying that decision was made on 13th Oct, they also included royal mail Tracking number.

Saturday morning 15th October parcel was on our door steps with all the documents and decision letter buried some where in pile of documents. Luckily they approved the HSMP :) but without mentioning with how many points.

Application was for my wife ans she got approved. She is here on “Dependent workpermit”. She works with reputed accounting firm on a dependent workpermit visa. I am on workpermit working as an Engineer. My workpermit visa is valid till July 2006, my 4 years period for indefinite leave will finish in May 2006. Wife's dependent visa is till Dec 2008 (They granted her visa according my previous workpermit stamps even though we applied for her visa with new stamp which is till May 2006. I have changed my employment last year and started working with a newly establish organisation so they truncate my visa and gave new visa for 1.5 years which falls 2 months over my 4 years stay on WP).

That is the scenario now Questions :)

1)My wife is on Dependent Workpermit , can she apply for FLR(IED) as an in country applicant? The guide line says Workpermit visa can be converted to HSMP visa as an in country application but it does not say any thing about Dependent Workpermit.
2)Is it advisable for me to apply for HSMP dependent with my wife's FLR(IED) for her HSMP ?
3)Will this change ,from WP to HSMP dependent, affect my 4 year period for indefinite leave ?
4)I read couple of previously posted questions, one of it says dependent will not allowed to work during the processing period. I have difficulty to agree with that suggestion because until i get my new FLR approved i would have my current valid FLR which should allow me to work.

Again the dates for easy understanding

My workpermit : till July 2006
Wife's dependent workpermit visa : till December 2008
My year 4 year period completes : on May 2006
Her HSMP application made from UK on : 6th Jun
Homeoffice received the application : on 7-8 Jun
Approval letter received : 15th October

Hi, welcome to this Board.

The thing I don't understand in all this is why your wife applied for her HSMP? Your four years on WP are up in May 2006 ... just say seven months away. And then of course you will apply for ILR.

Your wife? Did she come to the UK on her Dependent Visa at the same time as you? If so your application for ILR will include her as a dependent and she should get ILR at the same time as you.

Or did your wife come to the UK some time after you, and that is why the HSMP was applied for?

Just trying to understand the background here.

Hi John,

Thanks for quick reply, Ya sure let me explain it in detail. My Wife came in the UK in April 2005. We applied for her HSMP so we can make long term plans which i was hesitating to make with just a workpermit -For example buying a house. (Specially when i had to change my Job 3 time in last two year because my company went in to administration and bought by different people under different name and sort of things, but luckily i wasn't out of my work for single day in all this). Also with HSMP status i can apply for much more positions then i can apply with WP.
That was the idea behind applying for HSMP. We are married for 6-7 months now.

Questions are

1)Does she have to go out of country/or to home country for her EC or can she apply as an in-country application ?
2)If i apply as a dependent HSMP will the duration as dependent HSMP be added to my ILR time ?
3)I do not see a terrible need for me to apply for dependent HSMP at this point but if due to some Conscious in future if i need to change the workpermit can i at that time change my status to the dependent HSMP status ?



will be really thankful if you can help with these questions.

RedSpeed, there are others on this Board who are more knowledgeable than me, who will hopefully add their own comments but clearly ILR is better than HSMP for your wife.

So unless you fear you will lose your job again before you apply for ILR in just seven months, or your wife wants to change jobs in the near future, why not forget your wife's HSMP approval and simply put her on your SET(O) form next May and get her ILR at the same time as you get yours.

In case I am missing something obvious here .. other views very welcome.

Hi John,

spoke with a gentleman in IND last week. As per IND

1) Dependent workpermit holder can apply for their own HSMP EC as in-country applicant.
2) If one wants to convert from WP to HSMP dependent then he/she also can apply in-country.
3) If one become HSMP dependent from Workpermit holder the ILR period for which he/she was on WP will restart.

Yes RedSpeed, and it was because of what you write in your no. 3 .... the ILR clock will restart ... that leads me to question whether pursuing the HSMP is a good idea at all.

Surely best to wait just seven months ... to next May .... and then both get ILR ... far better than getting HSMP now.

I agree with John. Don't switch to HSMP dependant status. Just apply for ILR in May 2006, otherwise you waste the 3+ years you've put into your ILR clock.
