Question regarding EEA3 application - Student/Worker

I have a question regarding making an EEA3 application and I would like to ask for your advice. I am an EU national who came to UK in July 2009, and started working part-time in August 2009. Also I have enrolled in full-time university course from September 2009. Since then I was studying + working till August 2011. Same month, August 2011 I have made quite a big decision to start new BA course in better university from the beginning. Because of changing university I had to move to another city and was not able to find part time job since I have started my new course, as well as the course was much more intense and I had to spend more time for my studies.

Now I have just graduated and I am thinking if I could be eligible to apply for permanent residency. I will try to make a clearer outline of my activities during these 5 years in the UK.

WORK:

Started first job in August 2009 (I have signed contract). Worked part time with variation of 15 to 25 hours a week.

Obtained UK Worker Registration Scheme (WRS) Certificate in December 2009.

I have changed my work place, after like a year of first employment and have obtained WRS certificate for my new employment, which was part time as well.

Stopped working in August 2011, mainly because I had to move to another city.

I have letters signed by my managers confirming my employment and dates when I was employed, 2x P60s, contracts and payslips.

STUDY

Started my first full-time BA course in September 2009. Completed 2 years and decided to switch to another, better university.

Obtained Certification of Higher Education from the first university with transcript for 2009 and 2010 proving that I was a full-time student.

I think it's worth pointing out that even I have switched universities it does not breach my student status. It counts as continuous studying period as I did not have any breaks.

Started my new BA course in September 2011 and graduated in July 2014. Obtained Bachelor's degree which includes transcript for the 3 years of studies.

I have read few posts before in this forum and found out that student must have CSI in order to be eligible to apply for the permanent residency. I am not really aware of the meaning of CSI, but I guess it could be the comprehensive health insurance.

Regarding health insurance, I have got European Health Insurance cards issues by my home EU country for the 2011, 2012, 2013 and 2014.

The problem I am facing is I am quite confused if my stay in the UK is eligible to apply for the permanent residency. As I have stopped working in 2011 and since then I haven't worked until I graduated.

I have also read that if applying as a student you should be self-sufficient - my parents were sending me some money to cover my living fees and, therefore for the 3 years I haven't worked, but I have never tried to claim any benefits and I think I haven't used any health care benefits as well. Just did few blood tests and was given few prescriptions for antibiotics which I have paid myself.

I would really appreciate any help or advice regarding my case.

I don't see any problem with that. You can apply for PR

askmeplz82, thanks for your reply! I would like to ask you one more thing. If I have already sent my application with all the documents, but I realized that I haven't attached my EHIC cards from home EU country. I have already got letter from the HO saying they have received my application and provided me with reference number. Also I have received email saying that payment was successful.

Two things I am not sure:

1) Shall I call them and ask how and where shall I send my EHIC cards to support my current application? Or will they ask me to provide it before rejecting my application? I wish I could just support my current application instead of applying again.

2) I have checked online and found that all EHIC cards have same standard and look the same, but are issues in host country's language. If I need to send them can I just send original EHIC cards or do I need to get them legally translated to English ?

Hi,
Just send the EHIC Card with your reference number on your COA. If you got any paper work for EHIC that would be added advantage, I don't think so you need to translate your EHIC card.

Thanks for your reply. I am not sure if I've got COA (not sure what does it stand for). I have only received confirmation letter that HO has received my application. In that letter there is H0 reference number, but where it says Your reference number - it just left blank.

What I really wanted to ask is, before they make the decision will HO ask for further documents to support application? Or will they just reject application straight away without asking to provide documents needed ?

Hi,
Check HO letter or just make a copy of letter, and draft your own letter stating that you are submitting more evidences for your application. For most of the applications they will simply reject without asking further proof, so that you will make new application or appeal. I would recommend you to send covering letter along with photo copy of home letter to accept further documents for your application.

Thanks! But where shall I send my letter to ? As EEA3 Form I have sent to HO office in Durham, but the letter I got confirming that they received my application is from HO office in Liverpool. Which of these addresses I got to send my additional documents?

Got letter today dated 22/09/14. It's refusal letter and it states that I was refused because I have not evidenced that I had sufficient funds in the United Kingdom not to become a burden on the social assistance of the United Kingdom for the duration of the study.

Few points:

1) I've applied for PR already after I graduated and while studying I have never asked for any social assistance.

2) For the years I studied my second degree 11-14 my parents were supporting me by sending me money to my home bank account and I was just withdrawing money from that bank card in the UK. It wasn't big money, but enough for me for my rental and living fees.

P.S when applying I haven't attached any of my UK or home country bank statements (maybe it was the mistake) ?

3) What does it exactly mean 'sufficient funds' how much shall it be monthly or annually ?

4) Shall I appeal this decision or just leave it ? If I can appeal by trying to prove I had sufficient funds what do I need to prove so ?

5) Letter says:

In making decision to refuse your application, consideration has been given to the following:

EEA3 application form

National identity card

WRS certificates

Evidence of employment

EHIC cards

Evidence of study
