Important Appendix FM Judgement on Evidence Flexibility

A very important Judgment has been Promulgated.

It will be most helpful for people applying under Appendix, who for one reason or the other are unable, due to the nature of their job, for example a person paid cash in hand, or their business, cannot meet all the requirement of Appendix FM-SE.

The Judgement highlight the discretion in Paragraph D(e) of Appendix FM-SE, which is conferred on a decision maker.

If he or she fails to exercise it lawfully or Exercise it at all , then a person will be entitled to succeed on appeal.

It is generally a good judgement although the appellant failed in the end.
