Yes, she can, assuming you settled as a PBS applicant, it remains valid.

Hi Amber,

My Friend is completing his Tier-1 General 5 years in May 2015 and his wife has been on PBS dependent VISA since 2010.

They were supposed to apply for Settlement under this route, but someone advised him to apply via ILR Long residency as he has been in the uk since 2003. He did apply in May 2014 and got the ILR by Oct 2014. his wife is still on PBS Dependent VISA not FLR-M .

my question is can she apply for settlement under 5 year route because of being PBS dependent for 5 years ? or she needs to apply for FLR-M first and then spend 5 years more to be eligible for settlement ?

Please advise on this.

Regards,

Addy

Unfortunately, the latter.

Thanks Vinny.

Also Rashid & Rashid Lawyers are claiming that if your child has spent 7 years in the UK you can get ILR on that basis.

how true is that ?
