Tier 2 Licence Application help

Post by Sree88 » Sat Oct 31, 2015 3:04 pm

Hi,

I was in tier 2 sponsorship since 2 years. My sponsor withdrawn my sponsorship and I received the curtailment letter last week with 60 days leave till Dec 25th. I have found a potential employer who is willing to sponsor me but need to apply for the license. Is that feasible to get the license and apply for tier 2 through him within my allowed time, that is 25th Dec. ?

Many thanks,

Reinstating of sponsorhip

Post by Sree88 » Sat Oct 31, 2015 3:10 pm

Hi,

I was in tier 2 general, working as a contractor in various firms. Since my contract got finished and couldn't find a new one, my sponsor withdrawn my sponsorship and I have now received with curtailment letter from HO. My sponsor says they can reinstate my sponsorship under certain criteria without having to apply for the visa again. My question is, Is that possible to reinstate my sponsorship such a way if I'm already in the 60 days curtailment period?

Thanks.

If you were working as a contracting for different companies, was your sponsor an umbrella company??

Working for/through an umbrella company is not permitted on Tier 2 General visa!! It is not in line with the Tier 2 G policy and rules.

This would be permitted on Tier 1 General, so be sure you are aware of the difference as others might hold a different visa to yourself.

They will face problems, HO is clamping down hard and going through PBS applicants history with a very fine tooth comb.

No matter, it's illegal. One chap at my place got finished this week when they found his T1 was actually a T2 via a dodgy brolly. The rules are simple, all you have to do is follow them.

That's not right. There are many IT companies undertaking third party projects and employing their own staffs to execute it. That's not body shopping or illegal. Its been clearly mentioned in the HO guidelines on Tier 2. If the employees day to day tasks are assigned and monitored by the employer, he is allowed to work on third party companies and even their premises.

There is a difference between working for a sponsor and working at the sponsors clients to working for an umbrella company.

You said you work for an umbrella company. Did they take a percentage of your pay/salary?
