WHM what does 12 months consist of?

Post by tommyben » Tue Feb 12, 2008 4:35 pm

Hi,

I'm on the working holiday maker visa. I'm sure this question has been answered before but I cannot find any information

Does anyone know what 12 months consists of? Do holidays, weekend, bank holidays or sick days get added on to the 12 months?

Regards,

Ben

I don't know, but if you're asking if you can get a job working say 5 days a week and then count 365 days divide by 5 equals 73 weeks I would say you're taking the piiss.
Arguably any holiday entitlement could be added on to the end, as it's holiday.

Some people argue that it is 365 working days but if I'm entitled to say 4 weeks annual leave does that get added onto the 52 weeks of eligible work

On the other hand if one is a contractor and not entitled to annual leave and take random 3/4 day holidays here and there can those days be added on to the 12 months.

I've also read elsewhere that any days off beyond 20 days per annum can be worked on top of the 12 months

It just seems a very grey area and somewhat confusing.

Ben,

There are no if's and but on this you have a WHV for one year or 12 months.

Nothing is added or subtracted.

Remember this is a working hoilday visa and not a work permit!

This was clarified in a determination promulgated last year.

If you enter the UK on 20th December, start your job on 1st January, you have to stop working on 30th June, even if you have only been working one day per week and even if you have been given two week holiday in that period.
