MN1 parent's immigration status

Post by MJOvelar » Wed Nov 14, 2018 11:35 am

Dear all,

I am new in the forum and I have a question that I see other people having but that, after reading all answers posted in this forum, I have still not a clear answer for.

I am a European citizen that just got ILR earlier this month after providing evidence of my permanent residency here in the UK for the past 5 years. I am now filling up the online MN1 application form to register my two kids, both born in the UK, as British citizens under Section 1(3).

The question is the (in)famous one in the Parent's immigration status section:
"Are you relying on your parent's permanent residence (either as an EEA National or the family member of an EEA National) as evidence of their settled status in the United Kingdom?"

My first thought was to answer "No" because I have now ILR and the proof is, I understand, "attached" to my passport, but my husband thought that because my ILR was granted on the basis of me permanently residing in the UK for 5 years maybe we should say "Yes" and then provide all documents we already provided for the Settlement status application.

What should we do?
We have appointment early next week with NDRS.
Many thanks in advance!

You have PR under the EU rules not ILR under the UK immigration rules.

You need to answer yes to the question.

Thank you very much CR001, but I don't understand...here is some quoted text from the email I've got following my application for settled status with the UK Visas & Immigration Department:

"I am pleased to inform you that your application under the EU Settlement Scheme has been successful and that you have been granted Indefinite Leave to Remain (ILR) in the United Kingdom under Appendix EU to the Immigration Rules. This is also referred to as settled status. Your status takes effect from the date of this email, which can be found above"

Doesn't this mean that I have ILR?
Many thanks in advance!

Would have been useful to state it was granted under the EU settlement scheme trial being run.

You still fall under the EU rules.

Ok, CR001, many thanks for your quick replies! I am learning a lot :)
So then, just our of curiosity, what is the difference between my status and that of another european citizen that has been living in the UK for 5 year but that did not apply (and payed) for the settlement status?

And apologies for the lack of info in my first post, I will try to be more complete in my next ones.
Thanks!

You applied under the new settled status which will be applicable to EU citizens from next year. Many are still applying for normal PR now.

ILR and PR = Settled Status and mean the same thing.
