Wife to apply for naturalization

I will be applying for naturalization this Sept. as a one year ILR holder. If that is successful, can my wife apply as a spouse of British and ILR of over one year? She has been here only over 2 years but she got her ILR together with mine as I was on 5 year work permit. Can her status change from five years residency to wife of British national?

Your wife needs to in the country for 3 years (2+1 year ILR) to be eligible for Naturalisation application.

Thank you. She will be three years in November 2008 but her ILR will be one year in Sept 2008. So I guess she could apply by the middle of next year if ever I was successful with mine.

Generally spouse of a british citizen does not need to have ILR for a year to qualify for naturalization. You need to have ILR when you apply for naturalization. Theoratically ILR can be held for only one day provided three year residence requirement is met.

In OP case, you will have to wait till your wife completes three year residence to apply for naturalization as a spouse of british citizen.

jazbaati99 is right, as long as the spouse completes 3 year period, even 1 day of ILR is enough for naturalisation
