3.5 Months Short to ILR

Hello there

This post is about my wife application ,
she landed in UK in 17/07/2015 and she has the visa until 04/04/2020 which is a period of 4 years + 8.5 months .

Can someone advise what is the best thing to do Just an extention of visa to finish 5 years complete period or going for ILR application .

Mine is British passport , she is my dependent .

Please advise .

Does she hold a spouse settlement visa or a PBS Dependent visa?

What is her full UK immigration history including all relevant dates?

Hi Sorry about that

She landed in uk 17/07/2015
Initial visa expired 21/02/2017

Visa extension as PBS dependent - 04/04/2017 valid until : 04/04/2020

What was her INITIAL visa issue date she got from home country?

On what basis did you get ILR as zimba has already asked?

she got her first visa valid from 24/06/2015

I got ILR through Tier 1 General PBS

Don’t worry so much abt the fees.
She’s eligible for ILR end of MAY.
Initial visa issue date minus 28 days.

1. Apply directly for ILR nearer to expiry. Delay biometrics till end of May.
She must be eligible for ILR on the day of decision.

2. Apply for extension and vary application to ILR when she’s within her qualifying period.. variation can only take place if a decision hasn’t been taken on earlier application.. delay biometrics to delay decision.
Application fee/IHS fee should be refunded.

Yes you are right If we go for ILR directly , the processing time is about 4 to 6 months , by that time she qualifies for ILR however applying for ILR directly with out fullfilling the Major criteria of 5 years legally staying would it not be a problem ? i m confused with this option . I do not know if they notice 5 years not competed by the data of application 04-04-2020 there is a chance of rejection , though they reject by that time completes her 5 years time based on ILR processing times . If they allow us to make another application with in 28 days then we have to make again ILR application , is that possible making same application again . Second thing if they tell us to go for an appeal , this is another case dealing with more trouble .

The second option is more feasible which is i thought initially , applying for extension ,while this is in progress , making another application for ILR while the decision is pending on first application .

Use the time to read the guidances posted in the links closely and frequent the forum for clarity.

1. Visa applications can be ‘varied’ pretty easily as only one application can be considered at a time.
The timing is of utmost importance here.
A decision must not have been taken on the earlier application.

2. An “in time” application ( submitted before valid visa expiry) extends the terms and conditions of the visa (3C protection) till a decision is taken on the new visa application.

3. The caseworker calculates the continuous period residence in the manner in which it’s beneficial for the applicant. If the applicant is within the qualifying period on date of decision than the visa is approved.

4. A visa application is not valid or considered till biometrics are submitted.

5. Timing of tying everything up is of utmost importance.

Apologies , i know this is not the right question to post here but my wife's ILR application will follow after this PBS extension application .

Please can someone advise me what documents are required for PBS extension . I could not find any other forum to post this topic . Please advise .
