Hello,

My husband is an American, who was here on Tier 2 General visa (0ct 2014-Nov 2019), and has successfully applied for ILR (Oct 2019-Dec 2024). He will apply for British Citizenship in November 2020.

I have received my first PBS Dependent BRP (Jun 2016-Nov 2019). Then I have successfully extended my PBS Dependent BRP (Dec 2019-Dec 2022), I applied for the extension after my husband received his ILR. I am looking to apply for ILR in May 2021 (5 year route). I was wondering which form/route I will need to use?

I did the online eligibility test to find out if I can use Set(O), and everything seems to fit, except this paragraph "If you got your current visa as your partner’s dependant after they settled in the UK, you must apply as the partner of a settled person instead."

So now I am confused about which form/route I need to use for my ILR application.

There is only one route and that is form SET O.

The paragraph you quote is only for those who got their initial dependent visa AFTER the person has received ilr, ie a spouse settlement visa, not a PBS dependent visa.
