ILR Ancestral Visa 18+Dependant

Post by RPark » Tue Apr 27, 2021 4:22 pm

Hello all, We are applying for ILR through Ancestral Visa with a daughter who was under 18 on entry but has since turned 22. She is a full time student and lives at home. She does have a part time job. The problem we are having is finding the correct category under which to complete her individual SET O application(being that she is over 18) There is no category for Dependants 18+of Ancestral visa, and if we try complete the Ancestral Visa it requires proof via Birth Cert etc that she has a right to the category, which she obvs does not as she is a dependant on my husbands visa. Also the requirements for work etc are out of whack as a dependant. Trying not to stress but Im not sure how to complete the application accurately as the actual form does not apply to her circumstance. Please help:)

As far as I know, you can both use the same SET(O) form and add her as a dependant. You will be the main applicant and she will be a dependant

Hi Zimba! I have seen on the government site that if the applicant is over 18 they need to complete their own SET O application, but maybe I am wrong? I have seen several members stating that dependants over 18 need to complete their own application, but there really isn't an option for this on the online application. Im so confused.

Wait a hot second, I think she is added to the SET O of my husbands because its an Ancestral Visa and not a Tier or PBS! I hope that's right:) Thanks Zimba!

Sure it is fine. Dependant does not ONLY mean the PBS route

Me Again!
I am completing the SET O Ancestral ILR and Ive added my daughter who is 22 as a dependant, as per Zimba's suggestion. However there is no section which asks for her English Cert B1or UKN number for Life in UK Test. This is making me worried, where should I include this information? In a cover letter? Thanks again!!

With regards to the above, perhaps this is an anomaly on the application that has not been detected by anyone else as of yet?

If your child is 18+ you can not add her in the same account. She needs to apply in a separate SET(O) account and choose the correct option i.e. “Child above 18.” Only dependent children below 18 can be added in the same account. That is the reason you do not see LIUK and English Requirements section in her form.

Hi Cullinan, I agree with you, however if you refer to my original inquiry you can see that for an Ancestral Visa Dependant there is no option for them to apply via SET O. There is only a section for holders of Ancestral Visas, and my daughter is not a holder of an Ancestral Visa, her father is the holder with the evidence required to prove that : Granparent's Birth Certificate from the UK. I tried to complete the SET O with her under the Ancestral Category, but it requires all the employment etc which is not applicable to her case, but to my husbands as the Ancestral Visa Holder. I can see there is a PBS Dependants visa, and a Tier 2 Dependants visa for ILR on the SET O, but not one for an Ancestral Dependant, which is the option she is applying for ILR under.

I cannot see an option under Ancestral Visa Category for Child above 18. It does not have this category.

Let me run a dummy application and will let you know. I dont know what options it gives but normally all 18+ children apply on a separate SET(O) and choose “child above 18.”

Attachment 1 are the options.

Attachment 2 is normally how it is if you choose PBS dep, the next question asks the relationship. So child above 18 chooses the correct option.

Attachment 3 is where it gives option to choose “other.”

In your case, you are right the form does not give an option to choose UK ancestry dependent option. But maybe you can choose “other” then??

I dont think “other” is the correct option either as if you continue it does not apply in your case.

I tried the Other Option but that would not apply either it would seem. The stress is real. Should I call someone and point out the discrepancy? Who could I call?

Normally the SET(O) dependent child is below 18. If you will add child above 18 in the same account, the form will not ask about the LIUK/English Requirements etc as it would assume child is below 18. You can clarify in the cover letter and provide LIUK/English Requirements evidence.

This looks like a glitch in the system!!

I will attach the KOL and B1 Language Cert and state both in the Cover Letter, I'm just slightly terrified that Im filling in the incorrect Application Form, but I can't see any other options. I've run dummy applications in all scenarios and I can't seem to find another option for adding her. Thank you all for trying to find clarity with me, the more brain power the better! Much appreciated.

It should be fine as SET(O) is the correct form. Somehow it is not incorporating a sub-category for the UK Ancestry dependent for Child 18+.

Thanks Cullinan, perhaps they will have an update and that would kick the correct route in. Im going to go with the cover letter because there is no other way to tie her application to my husbands. Thanks again for the help!
