10 year route or 5 years

Post by rv77 » Tue Aug 23, 2022 1:25 pm

Good Afternoon,

Next year, I will be eligible to apply for ILR under both the 10 years continuous residence route as well as the 5 years Tier 2 General + Tier 2 skilled worker visa route. The 10 years route comes 6 months ahead of the 5 year completion route and wanted to check if that warrants an earlier application or should I wait 6 months and apply under the 5 year rule.

Thanks,

I highly suggest it if you meet the eligibility and absence limits. Minimal documents and you'll be free from work restrictions

Thank you. Can I confirm that you 'highly suggest' the ten years route?

i have read and re-read this statement to see if have understood it correctly "I highly suggest it if you meet the eligibility and absence limits. Minimal documents and you'll be free from work restrictions". I'm assuming you mean ten years Long Residence route is better than the 5 years T2 route. Please could you clarify.

You also mention that "you'll be free from work restrictions". I was under the impression that ILR is indefinite and without expiry regardless of the route one takes as long as they are not absent for two continuous years. What are the benefits of one route v. the other please? Appreciate if you want to point at previous threads if you don't want to repeat what has been said earlier. Thanks.

What visa is your wife on?

Or will she also manage to make the 10 years of lawful stay at the same time as you?

There is no difference at the end on what route you took to ILR. A path to get ILR faster is suggested. The only reason you may not want to do it sooner via the long residence is if you have dependants and you applying under long residence will reset their ILR clock

She currently is on a T2 Skilled Worker Dependant visa. Both of us would have completed continuous lawful residence in the UK for ten years, so can apply independently. Alternatively, I apply for ILR through 5 years of Tier 2 General + T2 Skilled Worker Visa and she can apply as a dependant/family member. Wanted to understand which of these routes is better i.e., minimal documentation and a better/faster success rate. Thanks.
