CCL students refused without appeal option

Post by picolla » Fri Jan 02, 2009 1:40 pm

hi

I know two students of CCL being refused without right of appeal. They have been given one month to leave the country. They applied 3 months before college being caught in scam. They received on 20 dec.

so no hope for CCL STUDENTS.

It looks like refusals may have started for CCL. If you want options in this scenario, there may be some but be prepared to shell out wads of cash, this looks like Judicial Review route only. This will involve Treasury Solicitors on the Home Office side, not presenting officers and the AIT. As far as I am aware the HO has a good track record on this sort of stuff. They will have the brightest & best after your a*** in court.

People have said start packing. If this is true, then be prepared to leave and book a ticket yourself if you want to leave with a bit of dignity. This is not an insult, but a bit of advice. Enforced removals are not nice & do not give you time to sort out your affairs.

The only other options I can think of is if you are married to a British or settled person and coming back, or go to ground and be forever looking over your shoulder and hoping to put in an application on human rights grounds in the future. 14 years may not exist in the future.

All those thinking that varying their application to something else, or withdrawing it please read the following, and note in particular bits I have put in bold.
Grounds on which leave to remain in the United Kingdom is to be refused
(1) the fact that variation of leave to enter or remain is being sought for a purpose not covered by these Rules.

(1A) where false representations have been made or false documents or information have been submitted (whether or not material to the application, and whether or not to the applicant's knowledge), or material facts have not been disclosed, in relation to the application.

Grounds on which leave to remain in the United Kingdom should normally be refused
(2) the making of false representations or the failure to disclose any material fact for the purpose of obtaining leave to enter or a previous variation of leave;

Other people may have other options. I am not going to point them out apart from use an OISC registered representative - probably qualified to level 3, or check the Law Society website (relevant to England & Wales)

If what I think is going to happen, actually happens, 2009 will not be a happy year for many.
