I agree with you guys. If awarding bodies are Universities then HO will treat your application as normal. I havn't see anyone in troubled from reputable and proper universities. All these upset people are from college having diploma machine like CCL, BITE, LCMIT etc etc.dildarya wrote:Hi

what i believe in this matter is, they (HO) holding the cases only where the awarding body of your qualification is itself the institute like CCL and others.
Apart from these awarding body institutes cases, other delays are just routine delays.
COLLEGE IS ALWAYS DENIED BY HO...........ITS NORMAL DELAY.......SO BE PATIENT.....candyshop wrote:I agree with you guys. There must be a reason for that.....................what is it?b52 wrote:My friend got PSW refused , reason BITES refused to confirm its own certificates, refual date 22nd , docs received today.
He will speak to college authorities to find out where the problem is? He got student leave to remain , so he can apply again for PSW after getting verified documents from college.picolla wrote:hIb52 wrote:My friend got PSW refused , reason BITES refused to confirm its own certificates, refual date 22nd , docs received today.
sorry to hear that ur buddy refused.
can you tell us why BITES not going to verify? If not, what ur friend going to do?
PGD in business. He cannot appeal because he got valid leave to remain as a student. To exercise right of appeal , your leave to remain must have run out. There is no adminstrative review option under tier system, if your applying within UK. He has a right to lodge a new application with new fee (regardless of out come), this is the only option HO gave him.Wanderer wrote:Appeal what exactly? You can only appeal for what might be an error by the caseworker or somesuch, there's something rotten in the State of BITES....yore23 wrote:did he make an appeal??? which course was it???
Did your friend actually study at British Institute of Technology and E-commerce?b52 wrote:PGD in business. He cannot appeal because he got valid leave to remain as a student. Poorman has to gamble 400 again to get deception removed from his name
UKBA wrote:Grounds on which leave to remain in the United Kingdom is to be refused
(1) the fact that variation of leave to enter or remain is being sought for a purpose not covered by these Rules.
(1A) where false representations have been made or false documents or information have been submitted (whether or not material to the application, and whether or not to the applicant's knowledge), or material facts have not been disclosed, in relation to the application.
Grounds on which leave to remain in the United Kingdom should normally be refused
(2) the making of false representations or the failure to disclose any material fact for the purpose of obtaining leave to enter or a previous variation of leave;

Does anyone know why they are not verifying certificates.
Please note that your friend may be refused with any future application. If your friend has used bogus documents, I cannot really see why that should not normally be the case.

His main concern is to prove that he did not committ deception. If he fails to prove his innocence, then he cannot apply for further leave to remain under tier system. The only option left for him will be to apply for a spouse / dependent visa.
His student visa is still valid without any condition.
i think this is certainly not possiblemscorpio wrote:b52 wrote:He will speak to college authorities to find out where the problem is? HI
Why not change the institute and get admission in the university or in a recognised college and then later apply for FLR S.
Don't you think it will be a wise decision?
regards
It does matter, because if someone actually did study at a college they claimed to have a PGDip from, my advice would be different, and their options would be different because they would not have used deception. If they haven't been studying, can they honestly be surprised at the result of their latest application.salam123 wrote:is not really matter where he studyed or not..........
A good idea apart from the fact the fact that a student has to show progress in their studies, also good attendance, and I think that if the evidence of progress is a bogus PGDip, then people are going to have problems doing this for FLR as a student.mscorpio wrote:HI

Yes i do agree with it, but if he will study in the next course and if can show some progress in studies then may be getting FLRs is easiere. Atleast a much safer optionPaperPusher wrote:

I totally agree with you. I was assuming that B52's friend was a genuine student and has problem with the institute. The second reason why I wrote this because his friend still has got leave to remain as a student so he can still study. If UKBA consider him a fake student then i think they will curtail his student visa as well.PaperPusher wrote:mscorpio,
I do not think you understand. Someone cannot show good progress and attendance for time that they have claimed a bogus certificate for. They have been caught out over what they have been claiming to be doing over the past year to 18 months. It is past progress that counts, not possible future good progress. I have a feeling that lots of the people affected by the problems with these colleges will not have completed a bona fide course for most of the time that they have been in the UK.
Just putting in a new application does not magic away the previous bogus documents.
It is too early to tell how this will all pan out, but I do not think that people should get their hopes up.
the motto of my writing is.........last year which course ur friend got extension of visa and how long the course was for???????mscorpio wrote:I totally agree with you. This is my personal opinion and I will welcome you to please correct me. After all it will help the students
Anyway if his friend is not genuine then in that scenario my suggestion is not suitable.
