ILR and naturalisation after the new rules come into effect

Post by agileflower » Sun May 03, 2009 8:06 pm

I just decided to read up on the current bill as it stands as I was totally unsure how folks in my situation (ILR but now non spouse, non HSMP etc) would fare.

The beginning of it reads: 39 Exceptions to application of this Part
Nothing in this Part shall affect an application—
5
(a) which has been submitted at any time in the twelve months after the
commencement of this Part by any person for indefinite leave to remain
in the United Kingdom, or
(b) made prior to the commencement of this Part by any person, for the
following—
10
(i) indefinite leave to remain in the United Kingdom; or
(ii) British citizenship.

So I read this as those with ILR who will be eligible currently to apply within the 12 month period following any 'officialisation' of the new rules (2010?) will be able to apply under the rules currently in force before the new rules. I also read this to say that there will be no impact on those who have, at the time of implementation, applied for either ILR or naturalisation.

I'm due to apply for naturalisation April 2010 w/ ILR having been gotten in March 08.

Phew. :-)

I had read that thread and there still seems to be debate on wether people really belive there will be retroactivity or not, other threads where ppl were worried they'd fall through the cracks etc etc. Sorry - I was just wanting confirmation and perhaps to give out somehelpful information.

Well that's the best thread. Nothing to be done until the law goes into effect so it is all needless worrying the first place and you certainly don't warrant special treatment because you opened another thread so please stick to the thread you were referred to.
