Over 18 dependant- qualifying period

Post by shahmsc » Thu May 14, 2009 1:37 pm

I came in to the uk on HSMP visa in Nov 2004. I extended visa then on the very next year and obtained another three years extension till Nov 2008, including my wife and two childer over 18 years of age. Later on, I again applied to extend my visa in nov 2008 and under the judicial review i successfully obtained further extension till 2011 again including all my dependants. Now, according to judicial review for the applicant came before 6 apr 2006, if i apply, i will get Indefinite stay to remain in the uk.

Now, my daughter is 25 years old and she had not stayed here for her entire duration of the visa because she was pursuing her study in india. she has been living with me for one year. she has got visa till 2011. if i apply for ILR, would her application be considered as my dependant to get ILR? or does she need to stay in the uk for 4 years of time to be eligible for ILR?

I would like to thank you in advance for your help

If she is now living in the UK with you then she should apply for ILR (198) at the same time as you.

Thank you very much for your prompt reply. Now my concern really is about the qualifying time, does she need to satisfy four years times separately?

cheers

As it's not mentioned in 198, I would say no.

Further to my above question, if i apply for my daughter as my dependant, which form does she need to fill up for ILR as she is above 18 years of age? she has been working full time in the uk, will that affect in gettting ILR? as i she has been living with me and i bear all her expenses.

thank you very much in advance for your help

cheers
