Spouse Visa to ILR

Spouse Visa to ILR

My Mexican husband first came in on a spouse visa in March 2007. When it was time to renew it, we were in Mexico so we were told by the British Embassy that we couldn't apply for an ILR we had to apply for another spouse visa, which we did and my husband got. My question is: he will have been in the UK for the 3 years required for British nationality before his spouse visa runs out. I understand though that he can't apply for British nationality without having ILR. Is it possible to apply for ILR before a spouse visa expires?

Subject to the KOL requirement, he may(?) be able to apply for SET(M) now, based on his initial entry on his previous spouse visa.
