Need urgent help Leave to remain Application

Dear Members,

Need some urgent help.

I applied for Tier 1 extension on 21st of September 2009 and visa fees payment did not go through because bank thought that it was a fraudulent transaction and did not authorise it(I gave my debit card details in the application).

I received a letter of acknowledgement on 23rd and got back all my documents on 1st of october 2009 with a letter dated 29th september asking me to make a fresh application.
Issue is my visa expired on 25th of september. So, don't know if my application will be successfully or not and NOT SURE if i have to if fill the D5 part of section2 which asks "IF my leave it remain is unavailable" and the questions after that are very scary.

very urgent any kind of suggestions or success stories will boast my moral.

Hi Chandra,

I might be on shaky ground here, but i think since your leave has now expired, you cannot make a fresh application from here. Instead you might have to go back to your country and apply for entry clearance.

If it were a rejection because of some invalid or missing documentation you could always appeal, but I do not think you can appeal in this case.

This is my understanding but do wait for other members to comment before taking any decision.

By the way which bank debit card did you use? There are a lot of people on this forum who used debit cards without issues, it would be a good pointer for people who bank with this bank to be careful while using its debit cards for payment. I am myself planning to pay by my LLoyds Tsb card and am applying tomorrow so would appreciate if you could share this information with us.

I used Lloyds TSB Inform the bank well in advance to authorise any payments coming from Home Office. It is really stupid that big banks don't trust Home office transactions.

I can't go back and apply because I have bachelore's degree not masters

Here is what I think you should do - They said you make a fresh application. So, make a fresh application by ensuring that bank statements , pay slips, proof for maintenance funds, etc all are correct as of date and submit it to UKBA for a decision. Tell your bank also to be careful this time.

Please also attach the rejection letter that you have received and mention in the Cover Letter that you are submitting a fresh application and make a reference to the rejection letter. Also an apology letter from the bank that they thought that it was a fraudulent transaction and did not authorise it.

Continue to work as normal till you hear on this fresh application from UKBA. It should turn out fine. In section 2 of application, D16 you should say "yes", and in D17 explain your situation. Give all answers correct and do not hide anything. UKBA people love Truth. If I were you, I should do it real fast, in one or two days.

As letter from HO asks you to make a fresh application, I believe you have a chance. Good luck!!

(Make sure you use the latest version of application form issued today).

Sorry mate, THE CREDIT is all yours, if his application turns out successful :) . Besides it is not exactly a COPY/PASTE, you would have said an "edited revised version" of your post, under his conditions (please see the highlighted text, which is completely absent in your post and some other which I have deleted). Actually this is what one of my friend has previously done, and done it sucessfully. The thing is that you might have talked about, is it right to so that in his circumstances or not? Anyway, as I have already said credit belongs to you.

Thank You so much for your timely help. I got a letter from the bank confirming that they have stopped the visa fees payment because of security reasons but refused to apologies, they said they were doing their job. I have also taken a bank statement from the date I posted my first application till date which shows that there are enough funds to authorise the transaction. I will keep you guys posted about it. Is there anyway I can get a same day appointment and submit the application. In person I can explain better though I have mentioned a detail story of what has happened. Please let me know if i need to submit anything else????

Great!! As far as I understand if you apply in person, it might take some time. Post should be fine, you see your previous application was processed real fast, around 10 days. Cover letter will represent you, so write a good and clear one and go ahead. Good luck!!

Agree with mvent00... You may not get a In Person appointment quickly so post the application again with bank's letter and thorough explanation in cover letter.
