ILR for Tier-1 dependant (2 yrs clause)

Post by 716mv » Wed Nov 04, 2009 7:54 am

Friends,

My query is about ILR eligibility for Tier-1 Dependant.

I have read a clause about 2 years for dependants to be eligible for ILR. This is on UKBA website if you navigate to (Working in the UK > Highly skilled workers, investors and entrepreneurs > Highly skilled workers > Settlement)

==========
How your dependants can apply for settlement

Partners of highly skilled workers are eligible to apply for settlement at the same time as the highly skilled worker, provided they have lived with their partners in the United Kingdom for a minimum of two years before applying for settlement.

Children of highly skilled workers are eligible to apply for settlement at the same time as the highly skilled worker, provided the child meets the requirements of the immigration rules.
==========

My wife has been in the UK on her own workpermit for 2 yrs and 6 months. I will be eligible for ILR in May 2010 based on (3 yrs WP + 2 yrs Tier1).

>If my wife becomes Tier-1 dependant, will she be eligible for ILR with me ? Or does it mean that my wife has to be in the UK for 2 years as Tier-1 dependant before becoming eligible for ILR with me.

>Has anyone's dependant got ILR with main applicant where the dependant has been in the UK for less than 2 years.

Thanks for your time.
