Dependent Query for HSMP Holder 2006

Post by Immigrant06 » Wed May 19, 2010 11:52 am

I entered the HSMP in 2006 before the PBS was introduced. For me there was no requirement for funds maintenance. Now in furure if my wife wants to apply for dependent visa, Do I need to show the maintenance funds as this was not a requirement for HSMP?

Best regards

Is your wife in UK as your dependent? Or yet to apply for EC as dependent from the country of residence?

Hi sushdmehta

Thanks you very much, She is not in UK. She has yet to apply for entry clearance from the country of residence and for that I was quering whether the maintenance fund requirement is waived for me.

It will depend on the local BHC. It has been my experience that local BHCs are forcing dependents (of HSMP JR protected migrants) applying for EC to submit the application using VAF10 form and pay associated Tier 1 fee. When VAF10 form is used, one has to comply with Tier 1 requirements (including maintenance).

If VAF2 form is used (provided your local BHC accepts it), then Tier 1 fee and Tier 1 requirements do not apply.

Hi sushdmehta

Ok. Thanks

I think I need to check whether my BHC accepts VAF2.

I will try to tell them that I was initiall on HSMP in 2006 and then got extension as Tier1 General (as per old rules - JR).

Best regards

Hi sushdmehta

Thanks very much.

I have 2 more queries

1) among the list of forms available, VAF2 is mentioned as Employment, does this form also work for dependents?

http://www.ukvisas.gov.uk/en/howtoapply/vafs/

2) If I have to use VAF10, can I use my business bank statements for manitenance of funds if accountant writes that this was my income in the last three months and I am also the only director of my company?

1. Yes
2. The maintenance fund has to be in a personal account that's in your name / your spouse's name or a joint account in your & your spouse's name.
