we have not heard from ukba for more information, our agent asked us but dont know if everyone is

we are hoping for the best this time but who knows what will happen :(

i already had to send my employee home on 21st october as we were hearing from october panel and they did not even processes the application even through we had put in on time

My HR have heard from UKBA for more information. They asked for all new sponsors to resubmit the application because they made some changes to the application form.

They also gave a critical piece of information which is really bad; they said that they processed and approved "only" extension applications in the month of October. They did not say anything about November. Lets just hope they atleast give some consideration to new applicants, the whole situation has gone completely out of control with people like us who are already in UK have to lose everything and leave on such a short notice.

I should know the result by tomorrow and Im worried beyond belief.

Well, still waiting for the CoS . My Tier2 application is in UKBA. Yesterday I had the appointment for biometrics.
Last week my employer got the sponsorship licence but no CoS allocated.

i have recived a reply about our CoS request today (PSW to Tier 2, Tier 2 visa application is submitted without CoS). Its bit strange as we have submitted our CoS request for monthly panel consideration. However email from UKBA says;

Your request for an urgent initial/additional allocation of Certificates of Sponsorship outside of the monthly panel has now been considered by the Deputy Director of Sponsorship.

I don’t think we have submited CoS for urgent consideration. Looks bit strange to me. + on UKBA website it says that this months panel will assess CoS request on 19th of this month.

email from UKBA also says; Please note however that your allocation request to cover your non-shortage occupation requirements as detailed on your ‘Tier 2 (General) – Request for Initial or Additional Allocation of Certificates of Sponsorship’ form has been rolled over to be considered at the next panel meeting.[/i]

As you will find in the forum, there are a few of us who have submited the Tier2 application without CoS because our visas were running out. However it is not something that UKBA encourages to do and they might well refuse the applications straight away as invalid.
I qualify under transitional arrangements so I didn't have much to send in terms of documents. I sent the application form, two photographs, a cover letter from me, one from my employer and one from the solicitor who is representing my case and I paid him a hell lot of money.

This is not a good news at all for people like me, who are not on shortage list. It looks to me like they are still only prioritizing extensions and shortage occupation applicants.

My case is also being considered urgently as my employers had requested, and we will find out the result tomorrow. A part of me is still hoping for the best. Lets see.

Good luck to all, and I hope there's someone somewhere listening to the ordeal that we are going through without any fault of our own.

WHERE DOES IT SAY ANYTHING ABOUT THE 19TH? I HAVE LOOKED ABOUT ON THE UKBA SITE AND IT STILL ONLY MENTIONS THE 12TH FROM WHAT I CAN SEE!??? ALSO URGENT REQUESTS ARE SEEN TO ALMOST STRAIGHT AWAY AND NOT AT THE MONTHLY PANEL MEETING. MAYBE YOU WERE WANTING TO JUST SUBMIT FOR THE USUAL EXCEPTIONAL CONSIDERATION BUT THE PERSON SUBMITTING (YOU?) ALSO MARKED THE REQUEST AS URGENT? WHICH IS ALL IT MIGHT NEED TO BE CONSIDRED AS AN URGENT REQUEST AS PER THE SPONSOR GUIDANCE, AND UNLESS YOU MEET THE REQUIREMENTS FOR THIS, YOU WILL MOST DEFINATLEY FAIL.

YOU MIGHT BE LUCKY IN THE FACT THAT THEY HAVE PUT YOUR APPLICATION FORWARD FOR THE USUAL PROCESS - IN WHICH CASE YOU WILL BE AT NO LOSS FOR YOUR CHANCES FROM THAT IF YOU HAVE SUBMITTED IT WITHOUT URGENT CONSIDERATION.[/b]

Hi everyone,

I have good news, I received my cos today. It was being considered on urgent basis so I got the result before 12th panel (and yes the panel is still on 12th not 19th) So the news is not only good for me but also for other applicants for these reasons:

A) It is clear that UKBA is now considering all applications and not only extensions.
B) I was not on shortage list and still got the cos.
C) I am not highly paid and come into E section of their priority and still got through.
D) Urgent consideration cases have a very small number of cos available and still i managed to get one.

The reason I'm giving these reasons here is to tell you people that all is not lost. UKBA is not filtering applications only by salary etc, they are going through each genuine case. And the reason I have explained all this is to let you know that if I got it then rest of you will also get, so be strong and be patient.

This forum had been an immense help, and good luck to everybody. Do not worry, its going to work.

It will help others if you could share with them the answers to the following:
1. Did your employer apply for CoS under exceptional consideration?
2. If yes above, was the job advertised for 4 weeks / resident market labour test conducted?

To answer your questions:
1: Yes my employer requested exceptional consideration as my visa is due to expire before 12th Nov panel result. So it was considered on urgent basis along with other such applicants. And this decision was made only 7 days ago.
2: And yes my job was advertised for more then 4 weeks before I joined the company (approx 6 moths ago) The resident labour market test was not specifically conducted for this purpose, but the initial ads on websites that my employer put for the position was considered as appropriate for this purpose.

Thats great news indeed! I guess it helped that the RLMT was conducted. Were you switching from PSW?

We too had submitted our request in October and I have been trying to find out if we needed to re-submit the request with the new form for the re-scheduled panel meeting of 12th of November.

My employer (sponsor) finanly called UKBA on Monday and was told that the old form would be fine but we would unlikely be considered for COS allocation anyway as they have only allocated to extensions and not much else so far. So for the panel meeting today our request is on the old form which I am sure will not even get consideration for not having the details of the RLMT which is the new requirement. Does anyone know for sure what is the case for this as there seems to be conflicting information.

Also, does anyone know or heard of COS being allocated for new hires in the past three months? It all sounds like it has developed into quite a mess with the UKBA.

Great news for you! If only I am so lucky once we here back from today's panel meeting. Although I am immensely nervous as our request was submitted in October before the new refined criteria that required details of the RMLT on the new form, that we did not re-submit after my sponsor was told on Monday that it would not be necessary. I am sure that is not right and our request will get overlooked straight away for not having details of those new requirements - but lets see...

Our request is for a new hire and also in salary band e, so I must have a similar chance to you is what you are suggesting as yours was considered as a new hire and not an extension?

First of all many congrats!

I would just like to ask you, did you submit some sort of evidence for the Labour market test, or was just just a matter of your employer giving details of the dates and place where job was advertised.

Because my employer got email to send those details but not asking for any evidence as such.

Your info will be greatly appreciated..

@ clippedw, Yes I was on PSW and now applying for Tier 2 Gneral, but its not an extension.

@ J_PO, yes I'm also a new hire in band E and not an extension, so dont worry you will get it :)

@ ashleyransoo, you dont have to provide evidence of the labour test if your job was properly advertised on website/newspaper etc before you got the job. This is what my employer submitted: details of ad, date when advertised, and website links. But try to give as much info to them about the ad as possible e.g any agents involved or anything you think you can add. In some cases they require ad beig advertised on JobCentre Plus website, but I was exempt from it because Im in the creative industry.

If you do not score the minimum required points (70), you are not issued a Tier 2 visa.

Hi Guys...I was foll this board since a month. My employer had applied for a COS for me in Oct for the Nov panel. My visa expired on 5th Nov and so had to go back to my home country. Anyways I just recd the news frm my employer that I have been alloted a cos on the 12th Nov. I was on PSW, so am a new hire acc to the new guidelines. Hope this brings new hope to all of you! :)
