DO WE REALLY NEED TO APPEAL ON EEA APPLICATIONS IF REFUSED?

i have been rejected EEA2 application on the basis of providing invalid EU passport with right to appeal within 10 working days. Does anyone know will they really try to remove myself from the uk if i do not appeal? I have sent additional documents to the HO by fax and submitted another application with all relevant documents and referenced my case there as my own passport is in the HO. I'm sure i won't hear from HO at least a month and i'm currently without any sort of leave to remain except the Article 8 right to family life and freedom of movement under the EU law as my husband is eu national and has a residence card in the UK.
if anyone has any thoughts and facts from their own experience please share them with me, it will be very appreciated!!!!

hiya, yr case is similar to mine too.. i was rejected at a point with invalid eu, id-card (coz the eu id-card i submitted hasnt got expiry date on it), with a letter frm HO to send a valid passport or id-card within 28days and at that time my work permit in uk has expired during my eea2 application. so i sent a valid eu passport of my partner to HO the second day, and when i call them, they say my application is now going under reconsideration , and that i will hear frm them in few weeks. i wasnt told to appeal as u was told. if u sent them valid passport or id-card, they will take up yr application again. try to ring them and confirm the situation asap.

am a non-eu national , my application was rejected on d ground of my eu-partner's finland id card has expired( coz it has no expiring date written on it). and in the HO letter, they requested to send a valid id -card or passport, for the application to be re-considered. which i did the second day with a valid eu-partner's passport. and just of today 7-10-2010, HO told me to hear from them within nxt 10 working days for my RC. finger crossed.

What the Home Office is doing is illegal. As long as your EU partner has a ID card issued by their member state, it does not matter if it has no expiry date or is printed on red paper or the photo has a smile.

yeah, it shldnt be like dat.. but they claim all applicant shld submit valid id card or valid passport during their application. well, they av requested for valid passport, and we av sent it. and do u think they will respond as they said within 10 working days?
