ILR application for my wife

Post by ilrapp2012 » Mon Dec 13, 2010 12:43 pm

Hello all,

Hope you guys are fine.

I am just planning upfront for ILR for me and my wife. I am on Tier1 General Visa and would be completing my 5 years in Jan 2013. Though i need to apply for another extension to complete my 5 years first due to 2 months delay in UK arrival.

God knows if they would change ILR rules in future, but in anycase just asking I will apply for ILR along with my wife.

For my wife's ILR, they will check if for 2 years, my wife stays with me on the same address. Now here they want 2 documents to proof if she lives with me. My wife does not work.

I can provide following two documents:-

1. My tenancy agreement is on my and my wife's name and i can use this one. Unfortunately, none of the bills are on our name as we are sharing this small studio and everything is included in the rent, therefore i
won't be able to use any other documents except the tenancy agreement.

2. I have two bank accounts in UK, Lloyds and HSBC. Lloyds is my actual non-joint account, where i maintain funds and my salary gets deposited, but i have a joint HSBC account too. But i do not maintain any fund in this HSBC account and It only contains few pounds. I can use this document as a second proof that my wife lives on the same address as I recieve statements of HSBC on my wife's and my name on the same address.

Question?
1. Are these two documents sufficient?.

2. I am just thinking, at the time of applying, Hope my primary bank statement(Lloyds) won't confuse them with this HSBC one, as i am only providing this HSBC statements to proof that my wife is staying on the same address. For payslips and my salary, i haveto use my primary LLoyds banks statement. Is this OK?

3. If it confuses them, should i change my Lloyds bank to a joint account? to avoid any ambiguities or there is no need to do it?

4. Shall i take any mobile contract on her name, so that i can recieve bills on her name on the same address.?

Please if you guys can shed some light to it.

Many thanks in advance

Thanks for your immediate response.

And, that is really great, Just double checking as she is already on dependent visa, i do not need to provide evidence that she is living with me on the same address?

Cheers,

I think that it's safer if you do have similar evidence as requested on the FLR(M) or SET(M) forms.

Thanks for your reply. So, then again come back to my original questions. I do have the marriage certificate, i am only worrying about the evidence to show that we are living together for 2 years together,

1, Is, my secondary account which is a joint account too, sufficient to show?
2. i do have the tenancy agreement on my wife name too.

3. Do i need to change my primary bank account to joint account? Please if you can comment.

Many thanks

Please do read the advice given on the FLR(M) and SET(M) forms regarding documents that prove cohabitation.

as far as i know there is no necessity to have everything in joint names- it just makes is easy if there are.

you can have letters addressed to single parties both at same address. as moderator said refer to the forms for details of documents.

as you pointed out you are still long time away from 2013.
