Your absence shouldn't exceed more than 180 days in 5 years to qualify for ILR. If your absences exceeded more than 180 days you need to provide a proper explanation in the covering letter with evidence and also a proper letter from your employer confirming that the absences for Business purpose. I can see most of your absences were for business purpose. Also in one occasion, you went to india to apply visa, did you leave from UK before expiry of leave to remain? You need to make sure that you left the country before expiry of your visa. If you had left the country after expiry of your visa, i need more info to advise you further on this. You may probably apply in person, but it may turned to be a postal application due to your absences and it may require more investigation. You may get it on the same day and it is upto the case worker. I would advise you to apply through post. Don't worry about your absences as long as you give proper explanation with evidence, you should be fine.raj_2071 wrote:Dear all,

I did my PhD in UK and worked in Europe. I came back to UK on Oct2004 and was on work permit with University till August 2007. Later on from Aug2007 up until Nov2009 I was on work permit for University Spinoff Company. Currently I am on Tier1-G visa from Sept2009 and now working for a different company from Nov. 2009.
I have the supporting documents from the University.
There is a situation from June2009 to Sept 2009 due to a wrong application on the introduction of PBS. I flew back to India, applied in June 2009 for Tier-1G and, received it in Sept. 2009.
I have the job in which I travel abroad a lot on frequent business trips to India and Europe. It is always funded by University/Spinoff Company. I have listed the time I am out of UK in chronological order from Oct2004 till Nov 2009. I do have the documentary evidence from University and all taxes &NI are paid in UK during the entire period of my employment including my stay abroad.
Approximate dates of travel and purpose of visit are as listed below (Oct 2004 to Apr 2010).

That's alright, You had been out of UK many times for business purpose and sometime the absence exceeded more than 90 days, So just to make sure, Do you have continuous visa & work permit for last five years (Except that one occasion that you applied in india, which is fine)?raj_2071 wrote:Dear Senthil78,

As mentioned before with the introduction of PBS and phasing out work permit policy, a wrong application was made and, I was given time for right of appeal.Tier2 application was made instead of Tier1.
I was adviced it would be better to apply for Tier1, with rebuttal and cover letter enclosed, from India and hence flew before the expiry.
I have had enclosed all relevant documents and rebuttal when I applied from India in June 2009. I recieved Tier-1G visa in Sept 2009.
I hope to have answered your questions.

I don't think that you need any immigration consultant. If you are not comfortable in handling application, you may seek professional help. I can refer Victoria Sharkey from MediVisas UK.
