is it mandatory to submit 12 months bank stmt and payslips?

Dear Experts,
I had got the visa for 3 years. But I have come to the UK in the 3rd year of visa validity.

First I have come and stayed here for 40 days, searched for the job and got the job offer. But the joining was after 3 months. So I went to India and came back after 3 months, joined the job & started working.

I have 9 months 15 days validity for my visa when I started working.

As I had come to the UK and started working just 9 months 15 days before visa expiry , I don't have the bank statement and pay slips for 12 months in the UK.

But I have the sufficient earnings for the visa renewal with my 9 months income.


How my case is considered

1) Is it mandatory to submit the pay slips and bank statements for 12 months ? (OR) Can apply for visa renewal with the pay slips and bank statement for just 9 months?

In case if the 9 months are not allowed,

Can I submit my pay slips and bank statements from India (where I was working before coming to the UK)

Hi,

You don't need to submit 12 payslips. 9 payslips will suffice, as long as you get the points required for the extension using 9 months only.

Am I missing a point here? You want to submit your earnings from India? If you have not paid the tax in the UK, I do not think you can use that as an income. Anyone can get T1 and go back to home country and keep working there. Theory is that people come and work in the UK and pay tax. I am sorry if this is not what you were expecting or if I have read your post incorrectly.

Dear. Thanks for the response.
I am able to claim the points required for previous earnings from my 9 months income in the UK. So, I don't need to show my income from India for satisfying the previous earnings requirement for the visa extension.

My Question is:
Since we need to submit the payslips and bank statements for full 12 months period. In my case I have them for only 9 months.
May I provide the payslips and bank statements for the remaining 3 months from my previous job in India to make it full 12 month period.

I just want to be cautious that case worker should not reject my case on the ground of "payslips and bank statements are not there for full 12 month period"

Would you consider actually reading the information that people are providing for you? Otherwise why are you bothering to ask in the first place? Better still, read the guidance!

Dear Lucapooka,

Please don't mistaken me. I do consider every body's input because they are helping others.

I did read the points 83 and 84 in the guidelines. As per the guidelines I can claim points for previous earnings from less than 12 months.

Guidelines are guidelines but not the rules which case worker applies while taking the decision on the case.

Personal experiences are addition to the guidelines.

My self was victim of HSMP refusal in 2008 and the same application was considered without single piece of additional information in 2009 in the review. It was one of half year stint I had gone through. Those were the days we used to send all our original documents and receive them in the ordinary post.

I have posted the my query to know from others experiences but not for any other means.

Once again Please don't mistaken me.

I am just asking the people here for advice that "Providing the 3 months payslips from India income to make it full 12 month period",

would it be an additional info for the application?

would it be of no use?

would it lead to some other confusion?

kpr to simplify this for you (assuming that the rules in place before April 2010 are applicable to your circumstances) - say you need to score 25 points (£26000 to £28999.99) from your earnings in order to reach the qualifying mark, you do not have to earn the 26k in exactly 12 months. If, say in month 7, you have earned a total of 26k, you can submit your evidence showing your earnings for the 7 months. As long as you submit sufficient evidence to back the 7 months in question, you will be fine, and there is no need to submit evidence for the remaining 5 months - in other words you do not need to submit your earnings from India. Hope this is clearer to you now.
