hello everybody please i need ur help with a complicated problem my wife was caught in amsterdam with a brasilian passport they discovered that her informations was not registered on the chip of the passport and they said its a bad quality passport the passport was made in a passport office but has no file we live in brasil and we have our permante legally here she is from gabon she is in detention in amsterdam airport and they said in 2 weeks the court will handel her problem what do u think they will charge her for and where they will deport her to which country brasil or gabon thank u please help me we have a child here and he needs her i don't know what to do

I am sorry for the predicament you are in.Has she spoken to a criminal lawyer?She will possibly be sent down and afterwards removed to her country of origin if they can obtain travel documents from her embassy.

thank u for answering peppekalle yes she has a lawyer and he is trying to deal with the case that she has a son who live here in brasil and he needs her because she was going to stay only 10 days in france and now she is staying more ,but someone told me that they will send her back to brasil because she is resident here and got already permance of 10 years and her husband(me) and son live here too but all depends on the judge anyway

Is the passport bad quality or is this all a misunderstanding? If it's a bad quality Brazilian passport I hardly expect the Dutch authorities to return it to her. And given that she may not be Brazilian, she can hardly have the expectation to return there. You need to elaborate on the situation.

yes its a bad quality she is not brasilian but she got this passport with someone who work in the office where they make passport here but its not registered because she is not brasilian and she got it after trying to get a schengen visa from a different consulat here they refused allthough she brought them all the documents they needed and she wanted to enter to france to stay 10 days only ,well im sure that they will not give her back the passport but she is permanent here and she is legal in brasil what i need to know please if u have an idea will they send her to brasil or to her country gabon

Well she ain't going back to Brazil; the passport will be confiscated and likely sent to the Brazilian consulate for examination and investigation into the source. When the Dutch eventually sort out this matter, which may or may not involve criminal charges, she will likely be deported to her country if Brazil refuses her (which is probably going to happen). Does she have permanencia definitiva status to reside in Brazil and does she have a CIE card that shows this? It's all a huge mess of her own making and outside the scope of this discussion forum.

well yes she has residencia definitiva and rne (registro nacional de estrangeiro) for 10 years it means definitiva and brasil are not complicated with these cases so i don't think they will refuse her here

It's outside the scope because it's not an ordinary immigration matter where clarification of the immigration rules are being sought. Your wife is not operating within the immigration rules in a manner that may be discussed and clarified in these forums but, instead, has committed offences in both Brazil (by obtaining a bad quality passport) and in the Netherlands (by using a bad quality passport). The matter is in the hands of both the relevant authorities where criminal proceeding are likely and we can't comment on that with any accuracy. I would suggest that if Brazil is willing to accept her back (which is not certain given she is not Brazilian and nor are you), she will certainly be prosecuted on her return with a view to her eventual deportation. The only caveat to that scenario being her Brazilian child. We don't know how that system operates so can't really be of any help.
