how can I get my brother to stay in the uk

Post by sheree » Wed Aug 01, 2012 6:28 pm

Can anyone help me please. My brother has been in the UK illegally for 11 years.

He has a child here with whom he has some contact. He use to pick her up from school however he no longer does so . In addition he has mental health issues however he has never been on medication and the family cannot convince him to see a doctor.

He has 5 brothers and sisters and we are all British citizens. Our mother is 75 years old living in Jamaica and we cannot afford to have him deported to Jamaica to be a further burden to her. In the past my brother has been assaulted in Jamaica due to his mental state and we do not believe it is safe for him to return.

We would like to Help him obtain residency in the UK and also get himself together to be a decent father to his child and improve his quality of like.

We his relatives have been financing him and accommodating him since 2007 time. Our uncle with whom he was living is now deceased. He now has to live with other relatives from time to time.

I don't know where to begin or what can be done to ensure he is not sent back to Jamaica at his age 44.

He was previously detained and almost sent back to Jamaica.

I would like to know on what grounds could we try to help him to stay in the UK

You brother needs to seek legal help.He may have to rely on article 8.

Normally after detention you are chucked out, given temporary permission, immigration bail or wait for UKBA to make a decision ,appeal or you are given status.
What happened after his detention?

He was appointed a lawyer and has applied to stay on the grounds that he has a child here.he has to sign on at the immigration centre every 3 months

During his detention he was assigned a lawyer who has applied for him to remain in the uk as a result of his child whilst he has to register every 3 months at the immigration centre

Is the lawyer still helping him?He has to wait for the decision. If he receives a negative decision and they issue him with removal directions he can appeal and the judge will decide on the matter.

Ask the lawyer to chase UKBA.He is lucky he has to report every 3 months..... i had to report every week.

I'm afraid I'm not qualified to answer these questions as they are very specific to an individual case. Any response I give would only be a point of view. I posted each of your posts together in your original post so that others on this forum could read and comment if possible.
