need help....
i am on flrm now and my ilr due next month.
i had 3 points and fine through court (using mobile while driving - dec 2010)
cn any one tell me plz, i can apply ilr now or not?

The question is not whether you can apply or not, the question is whether you will be refused due to your conviction.
You have been convicted in court of law for an offence, and this offence takes five years to get spent. As per the immigration rules, your application will not succeed if you have an unspent conviction. |

nothing showing in police computer and crb my conviction.
what you think about case worker will he/she think of my family life, kids before deciding my case or i will refuse straight away? |

| One of my friend has similar driving offence and taken to the court, he has mentioned all details in seperate letter fo explanation.Since this is not a criminal offence he got his ILR done. I think there shold not be any issues in filing ILR. Any suggestions are welcome. I would suggest to ring UKBA and explain them the case they will direct you. |

thanks man, ukba don't give advice over the phone i think.
i will apply and hope everything will fine, also my points will remove from licence 25 july 2012 (after 4 years) which i received through court.
i spoke to solicitor today he said its all depends on case worker.

All the best mate , as I said it is very important to detailed the description in letter of explanation.You already paid penalty and stuff so I am sure case worked would consider your application against it.

It is not the question of one conviction or more, they need way to reject the visa and this is one. (Do they really mean that you can have convictions when you become British Citizen ...? ) I suggest you to check with UKBA as LIONKING said...
I dont agree with your Solicitor, It cant be case worker based in your particular case. It is only the question of whether it affects your case now or not.

Dear all,
I am applying ILR in jan 2013, i got three points FPN due to not follow the traffic sign. I applied the extension last year and mentioned this on my application. The case working make special note on my approval letter saying UKBA consider all type of FPN as conviction and i must have to declare this in my future application.
I am not sure if points spent in three years or five years ? will i be ok in my ILR ? |

Tamilmaran is incorrect again. Not surprisingly, the solicitor has given the correct advice that it all depends on the caseworker and whether they give discretion in your favour. |
