Hi
I came to UK in 2009 to do my MBA and finished my course in Oct-2010.
In Feb 2010 - I started a company.
I applied for a PSW and its valid till Nov 2012
I was working part time with the company while I started a job in Jan -2011
I quit my job in Dec 2011 and have been working full time on my IT business since Jan 2012.
I have filed my taxes as self employed for year 2011-2012
I have access to 50K pounds in UK
I have re-read the visa guidance and i am still not sure if I am eligible to apply for the Tier-1 under this business of mine. The point of confusion is that its asking that company must be formed in last 3 months from the application.
Are they any members who have applied with companies that were formed more than 3 months before the date of application.
Any help will be appreciated.

It does not matter that how old is the company. The requirements are:
1. Investment in the company should not be older than 1 year from the date of application.
2. Appointment of applicant as director of the company should be within 3 months from the date of application.
If you appointed yourself as a director of your company more than 3 months ago, then you can't use this company. You'll have to create a new company for your application. |

Thanks a lot for the response - bluebird
I became the director of the company when I opened it in 2010 - so its been over 3 months.
But I can create a new company and be director of that too and file for application under this NEW company.
Then I need to get a contracts with this company ...and everything else once again

Hi
I called 3 lawyers in London today who deal with Immigration and 2 of them suggested that its not an issue if you have been a director for over 3 months.
1 of them had the same comment as yours, to start fresh with a new company.
Its really confusing
