Long wait ended bad result
Applied for student extenison in june 2011
Visa Expired in sept 2011
Visa Rejection Oct 2011
Was on appeal,in the mean time finished my Masters and applied for PSW
I Applied on 15 march 2012 for tier 1 psw visa
Bio metric on 17 april 2012
On 18 August 2012 Mp contact they said,my file was opened on 14 august 2012
24 august 2012 again MP contacted UKBA
UKBA gave bitter reply,"if u can wait,just wait if not leave the country"
10/09/2012 09:30 my solicitor called me saying that "your application refused we will appeal"
isnt it funny,i asked for the reason why ...they replied as you are on appeal your application was refused bla bla
is there any one with same situation or any one got visa on appeal |

Brother if you go for appeal they will grant you visa i have read on some forum the same case but they were granted visa. |

Brother if you go for appeal they will grant you visa i have read on some forum the same case but they were granted visa. |

Did you make a fresh application for PSW after you withdraw your appeal? You cannot have application and appeal occuring at the same time. To make a fresh application you have to withdraw the appeal first. |

I had withdrawn the appeal than applied for psw.
Ukba gave Only one letter and my all documents and refunding fee also
Letter says " as you have out standing appeal we are unable to accept this attempted application.as indicated by tier 1 application form section 3c of immigration act 1971(as amended) prevents an applicant from making fresh application whilst an appeal is out standing or whilst an appeal could be brought."
I have confirmation letter stating my appeal was withdrawn from tribunal.
What is visa status now? What I will do ?

| I think you can appeal. Obviously the reason they refused your application was a mistake and they still thought you had an ongoing appeal but this was not so. The rules are on your side. Appeal and you will get the visa. |

i am more or less on the same boat the only difference is my appeal was allowed before APPLYING FOR PSW..
UR APPEAL WAS ALLOWED OR NOT FOR STUDENT VISA??

simply ukba sent me letter saying they cant accept my tier 1 application.
they didnt accept or reject my application.they sent my money back also.
But they said,i didnt withdrawn my appeal,but already appeal has been withdrawn and i applied for psw visa. i dont know is there any one with same situation.
Can i call ukba and ask regarding my application?

 dont worry
first of all if your student visa appeal was ongoing what was the outcome of that? did u go to any hearing? or u simply withdrew it?
secondly ukba wil not answer any of ur queries u should simply call ur solicitor and file an appeal even if they haven't given u right of appeal.
in my case the appeal was allowed by the judge.(student visa one)
and then i applied psw.
and now i am waiting for an outcome
i ll update u as soon as i get any response from ukba..

When my student bis refused, I went for appeal than I went for second appeal as first appeal was dismissed. Than I was on second appeal which was allowed later I finished my master than applied for psw. When I was applying for psw I had withdrawn outstanding appeal. So I don't have any more pending appeals to be decided.

may be its miscommunication
you should write a letter to ukba tier 1 . and send them the evidence that u didnot have any appeal pending

but here they didnt accept my application nor reject it......
its been more than 15 months i am suffering with visa status.....

i mean to say that ask your solicitor and legally present them with the evidence you have about withdrawing the previous application and tell them that there has been a confusion..
its important to raise this issue to their tier 1 department with the help of your solicitor and afterwards some MP.

When did you apply for PSW ? Did you include you Tier 4 BRP card with your PSW application ?. Can you give your timeline please. I am in same situation. Tier 4 student visa was refused October 2011, 10 November 2011 appeal was granted. Applied for Tier 1 PSW 12 of march 2012. acknowledgement letter received 22 march 2012. Tier 4 BRP card was received on 1st week of July and resent to UKBA with covering letter. After that no news...... |
