My spouse (non-EU national) got an EEA2 residence card in August 2011.
Between August 2011 and August 2012,
He was in the UK: From Aug. 2, 2011 to Oct. 23, 2011 and from March 24, 2012 to April 16, 2012.
He has been out of the UK: For the remaining months, and until now.
He should be back to the UK in December 2012: Can he enter with the EEA2 residence card or is the card not valid b/c he was out of the UK for more than 6 months b/t Aug. 2011 and Aug. 2012?
Thanks in advance! |

| Technically the RC may be invalid. But the carrier should only be interested in the expiry date of the RC which means there should be no problem reaching a UK port. UK border police should only be interested in the EEA national being resident in the UK and exercising treaty rights. If so, your spouse's right to enter is still in place. |
