HI,

My tier1 visa expires on Jan 7th 2013. I got an appointment for Dec 10th.
I calculated the 28 days before Jan 7th, that exactly comes on Dec 10th. But still there is some grey area in my mind, Could some one please confirm if my calculation is correct ?

You are applying exactly 28 days before your visa expire date.

you should be fine. Anyway, plenty of days available. you can reschedule the date.

Hi There,

I am due for my ILR on 21st Januray 2013. Do you think that I should be able to apply earliest by 24th December?

Also please could you let me know what is the best way to get PEO appointment as whenever I go and look for appointments I don't find any days available.

I have tried for last 3 days, but i couldnt get a slot that is after dec 10th . Is there any one here got ILR, who applied exactly 28days before the tier 1 expiry ?

I am also in a similar situation.
I have gotten a date for Dec 13th, but my current leave expires Jan 13, 2013. This actually totals 31days. But from asking around someone said they normally would count out weekends as they do not work weekends and when she made a similar application (application made May 7th and visa expires June 7th), the home office told her the application was still within reason and she was granted. Though i still intend to try for Dec 17th.

However can someone kindly advice if December 13th 2012 is a good date to submit the ILR application in person following my immigration history.

Entry visa; HSMP Entry: valid thru 08/01/2008 to 08/01/2010
Entered UK 31st January / 1st Feb 2008.
Renewed in December got Residence Permit visa valid thru 13/01/2010 to 13/01/2013


I understand that there is a 3month grace period for entry but am asking cause of the explanation of “When To Apply” in the Set 0 guidance form. See below:
5 WHEN TO APPLY
You and any dependants applying with you should
apply before the end of your/their permitted stay in the
UK.
There is a qualifying period to complete in most of the
categories on this form. It runs either from
- the date on which you entered the UK with a visa
in the relevant category; or, if you did not enter the
UK with such a visa, from
- the date on which you were first granted permission
to remain in the UK in the relevant category.
If you entered the UK with a visa several weeks or
more after the date from which it was valid for use, you
may need to apply for an extension of stay to complete
the relevant qualifying period.
Please do not apply more than 28 days before completing
the qualifying period. If you apply earlier than
that, your application may be refused. If that happens,
we will not refund the fee and you will have to pay
again when reapplying.

Kindly advice please.

I'm keen to know the answer too. My T1 expires on 21/01/2013, so the earliest I can apply by peo will be 24/12/12??
Also guessing there will be limited appointments around the end of December due to Xmas holidays. Any thoughts on this folks??
