Fee Award

Hi guys,

My appeal was allowed under the new Immigration rules E-LTRPT and Art 8, the HO did not contest. However i have been on legal Aid as am not allowed to work.

Underneath the determination the Judge says;

TO the respondent;

Its unclear to me whether or not a fee is paid or payeable in this matter.However as i have allowed the appeal and there may be a fee paid or payable i must consider making a fee award. i have decided to make a fee award of the whole fee,if any, which has been paid or may be payeable. i do so on the basis that all the evidence supporting this application was there before the respondent for many years.

Can someone please explain what this is about. Thanks

It means if you had to pay a fee for the appeal then ukba should refund it but presumably if you were in receipt of legal aid you didn't pay the fee.
