EU1 Form - Evidence of residence in the State

Me and my wife are currently renting a room in a shared house. We don't have the 3 items required:

- Letter from landlord/agency, rental contract or rent book

- Letters of Registration of Tenancy from the Private Residential Tenancies Board

- Utility bills in the names of both the applicant and the EU citizen

We just have the bank account with our address.

What should we do?

We are here in Ireland studying.

Ask your landlord for all these documents. If he cannot provide it, live elsewhere to a landlord who can.

I would have though bank statements were enough.

If one reads through the directive, you will see that in general, an EU national applies for a registration certificate (for a worker passport and employers letter required). A non Eu family member applies for a residence card,(passport, marriage certificate and residence certificate of EU family member required).

Ireland hasn't transposed the residence certificate. In such cases, the directive calls for any other proof of residence in the member state. While it is reasonable that the state checks that the requirements are met; if it chooses not to follow the format laid out in the directive; there needs to be some flexibility in what an applicant presents.

Bank statement can indeed serve as proof of address but the Irish system always want more than that.

It could be argued that you dont have to live in a house and have the address on your bank statement, and thats why the PRTB, landlord/agency, rental contract or rent book is required.

Can we present other proof instead of a landlord letter and prtb? My uncle is letting my husband and I stay without paying rent.
What else can we use? We will have utility bills in both our names and bank statements. Do you think thats enough?
All I could think of was a library card, picture of us in the house? :shock:

If we rent another place, is there usually a minimum term contract?

You should not have any problem.

A parent/uncle is perfectly entitled to allow you to live in his house. So ask your uncle to write a letter saying he owns/rents the house and you live there rent free, as valued members of his family. There is no law against living with your relatives and there is no law requiring them to charge you rent money. He may be asked for ownership documents or proof that he is renting the house (PTRB registration for him if he rents).

The library card is actually a good idea, and taking books out of the library regularly on it is also a good idea - these things help to show that Ireland is now your home.

Thats good news, however my uncle is a bit cautious and he says hes not allowed to sub-let so he is not willing to write me a letter. I have forwarded what you have written in the hope that he gets convinced!

he retired just lives in dublin and he has the same family name as myself as he my dad brother
