My wife is leaving the UK for 6 months. Is it an issue?

Post by binhn8 » Sun Feb 02, 2014 6:58 pm

Dear all,
I have a question would like to ask:
I am ILR holder and my wife is on tier 2(general) dependant which valid until 2016. For financial reasons, she doesn't apply ILR now. She has lived here with me for 5 years.
My wife and my daughter(British) are planning to come back to my country and live there for period of 6 months with our family.
Is it a problem for her ILR application in the future? As in set(O), the applicant need not leaving UK for more than 90 days in the last year.
Many thanks!
B

Evidence of subsisting marriage will be required.

If she is eligible for ILR, then she should apply now. Who knows how much more difficult and expensive things will be in the future?

Thanks Vinny for the advice.
We run out of money after my daughter was born so this is not a good time to spend more on her ILR. I really don't want to into the deep debt by borrowing from our family.

Her visa is still valid until 2016 so after 6 months so she can come back to UK in 2015 on her tier 2 dependant visa(I was on Tier 2 visa and now ILR holder) and living with me here for 1 more year.

Does she still need subsisting marriage evidence? What are evidence of subsisting marriage? We have married for more than 5 years and living together since then.
My concern is if the gap 6 months is an issue for her ILR application. (I also consider option to extend her Tier 2 dependant visa if needed before apply her own ILR).
