ILR GRANTED!

Post by modanger » Thu Sep 08, 2011 9:53 pm

Hi ah_Kassem,

It was a bureaucratic error on administrator level either by college or Home Office. I had given the application in full including all required docs. Application form was returned to me incomplete. It was quite obvious that 2 pages, sponsor's letter and my pitures were missing.

It was a nightmare for me to know that where are the other docs. I told to my MP that my ILR application has been being unjustified so please write to the higher authorities. I am thankful to my MP that he wrote in detailed.

So here is the outcome.

First gap is application rejected in 2003 due to incomplete form. I corrected and returned in 20 days.

Argumet given in the pre action protocol that ukba granted and accepted the application as valid under the policy of 28 days. (there are 2 high court allowed judgements).

Second gap in 2005 application refused due to college is not in the dfes list right of appeal was given but submitted fresh application and LTR granted with diffirent college details.

Argument given that i applied visa extension in 12-11-2004 and dfes was not launched until jan 2005 making college existance on it or not irrelevant and also email confirmed that college was in the list. It was an eror made by ukba and i was unjustified on that time. 3C also applied and accepted.

Regards,
modanger
so at least the second gap was due to the HO fault not yours.

My post will encourage those friends they have been refused due to previous visa extension refusal or application rejected etc that do not give up and you will achieve your target.

I have a great regard for my MP who wrote 2 letters to UKBA and 1 to Immigration Minister.

But UKBA has stated that i have provided enough evidence to convience them to grant me ILR.

Good Luck those are awaiting for their decisions.

Congratulations modanger. What do you mean by significant gaps and how long was each one of them. and did you have to leave the UK during the gaps/

Congratulations Niaz,
Can you please tell us what your method of payment was and what was the problem, was it from your side or theirs?
The only reason I can assume why they'd say starting point 4th July instead of date of postage is that it was from your side.
I think the reason for starting from 4th July is that they will not even look at the form before they get paid and 4th is that day. As for the delay in taking the payment it seems that 1 month and nearly 10 days is a long time to sort out payment issue???

I stll canot understand why it is taking 2 weeks from the stamp date to the delivery date. In Niaz's case he/she supplied self addressed special delivery royal mail envelope and still 2 weeks to deliver???

Application sent on 24th May 2011.

Acknowledgement letter received 28th May 2011.

Good luck to all who are waiting and be patient you will get it. Looks like though HO have is speeding up the process now.

Application Posted via Royal Mail Special Delivery on 08/08/11
UKBA Received it (Online Tracking Confirmation) on 09/08/11
Payment :Postal Order
Acknowledgement Letter sent on 10/08/11

No gaps between visas. Applied for ILR 26 days before qualifying date.

5 year Work permit valid until July 2012, but quitting job 15th Sept 2011 - eligible for 10 year ILR on 02 sept 2011 - would this be an issue? Could I work part time elsewhere whilst my application is being processed? Secured a new job, but can't start until I get my passport back.

Any advice please?

Hi, I applied 2 weeks ago and sent my 10 years passports, 2 photos and Life in the UK certificate and here is my timeline:

Application Posted via Royal Mail Special Delivery on 22/08/11
UKBA Received it (Online Tracking Confirmation) on 23/08/11
Payment Taken (Visa Debit Card) on 24/08/11
Acknowledgement Letter sent on 25/08/11
Acknowledgement Letter sent on 30/08/11

I completed my 10 years 3 months ago but could not apply due to poor health, my current visa (PSW) is running out on 30/04/2012. I also applied for my SAR which is showing no gaps. Waiting................

I have been a silent member of this forum...I got my passport with ILR yesterday:
Posted 30th June 2011
Letter received on 4th July 2011
ILR granted/stamped 22th August 2011
Passport received 03rd September 2011

I was very worried because I had an 11day break in 2001. My initial student visa expired on 30th Sept 2001 and new application was not lodged until 11th Oct 2001; extension received in December 2001. I spoke to 2 lawyers and they said I should wait until December 2011 when I would have acquired full 10years without a break but I decided to take a risk to avoid extending my WP which expires in October 2011. Thank goodness it successful. All other applications were in time and I sent a lot of documents to support my application.

Good luck to everyone!!!!!!!

Good Luck Adam, hope it happens soon for you and your partner :) .

I'll be beginning my 5th week coming Tuesday 6th Sept, so still some way to go...

As far as HO using a third party causing a 2 week gap between passport stamped and receipt is concerned, its a reasonable assumption...however it still doesn't explain the 8 weeks turnaroud we saw early summer. Those guys had upto 1 week gap between passport stamped and receipt from the ones that caught my eye.

I guess there is no way to get a clear answer to this delay...it does seem that all 10yrs ILR related postal applications are being decided in Liverpool (based on posts here) if i'm not mistaken.

Seventh Week is starting from 5th Sept. Haven't heard anything yet from UKBA since my wife's biometric enrollment (for her FLR-M) on 27th July at the post office.

Relatively straight forward application as no gaps, few days absence, no conviction in 10 years. Finger Crossed.

Faadi201 was your application straight fwd? Any clues as to why there is a 2 weeks time lag between ILR stamp date and receving the passport back?

Thanks! :)[/quote]

my application was straight forward no gaps no prob. regarding time lag i think HO has given this task to third party, this is my opinion.
