It's a hung parliament so the Conversatives aren't in. No party is technically in.

Labour are meeting with the Lib Dems today to come to agreement in the hope they can form a "joint" Government. Though I'm sure David Cameron hopes he too can form an agreement with the Lib Dems. Mr Cameron is posturing and making assumptions that he will get the support he requires from other parties to form a coalition. Why wouldn't he? He needs to show confidence and strength at this moment in time.

At the moment the UK is without a Government.

It looks like Conservative party will make the government and they will have tougher policies onimmigration which is good. I am personally against of soft laws on immigration and definitely don't want more people to come to the UK and abuse the system here. Look what they have done to this country; it's not the same UK that I seen in 1994 when I first arrived here... It's more like a foreign land now.

Actually if because of late submission, his/her visa renewal is unfortunately rejected by the HO, he/she may be served notice by the HO to leave the UK voluntarily by a certain date or face the prospect of deportation.

Of course, a person is given some days to appeal the said decision by writing to the HO to reconsider their decision and/or by approaching the Asylum & Immigration Tribunal (AIT) to prevent him/her being deported from the UK and if he/she decides to approach the AIT, he/she is permitted to stay awaiting his/her decision by the AIT.

From 15th Feb. 2010, AIT has been replaced, I think, by the 'Immigration and Asylum Chambers'.

The "gap" that ILR-2010 is referring to (correct me if I'm wrong) is when a visa has expired and the new one does not take effect immediately after that. Due various reason, i.e delays with the application, applicant having to go home for a period of time.

To further clarify:

Let's say a person's visa is expiring on 31st May. He/She has to make an application before or on 31st May to the Home Office (either in person or by post). If by post, more prudent to apply by special/recorded delivery so that there is proof he/she applied before the said due date.

If, however, for whatever reasons the person applies, let's say, on 7th June so this would, in effect, create a "gap" between the date when his/her present visa expires (30th May) and the date he/she applied for the renewal of his/her visa (7th June).

I wrote a letter to Mr Michael Dunne, Liverpool Settlement Team 9 last week where my applications is being processed. It has been more than a month now since I submitted more documentary evidence of my stay in this country that Home Office asked me to produce but no good news so far....

I have not heard from the Home Office since my application on 8 Feb 2010.

I applied once at PEO Croydon in Dec 2009 but had to withdraw for my travel back home. They could not make a decision although there's nothing wrong with my application.

I was compelled to withdraw because the officer said that I still have a valid work permit anyway - what's the hurry. He told me if I insist to proceed with the application I won't get my passport back and will miss my brother's wedding. He is evil!

I hope that'd not delay my application now.

Can anyone explain what's a gap? Thanks

That was an awful thing for the officer to say to you. They should try putting themselves in our shoes for a change. I think it won't delay your current application. If you look at the list no-one from January apps onwards has heard any news what-so-ever. So don't fret, some smart alex UKBA officer isn't going to delay your application

From SAR file I can see I have a gap due to rejected application back in 2005 (on the ground that fee payment failed to go through credit card)

Two key issues raised the Acknowledgement Letter:

(1) Make no urgent travel plans until Application is decided and passposrt is returned.

(2) Make no update enquiries until UKBA gets in touch with either requests for more information/supporting documents in support of the application or a decision on the application as originally submitted.

As others have rightly suggested on this thread, I've decided to WAIT VERY PATIENTLY. So, I am not going to be thinking about it at all except if the existing visa, which expires in 2 years time, is about to expire and I haven't heard from them, but I wouldn't think it should take that long for them to get back to me. I also think the application should be pretty straightforward because all previous visa extension requests contained no instance of "out of time" application. And, all the previous visa stamps were affixed on one passport which I submitted with my application. Also, the total number of days absent from the UK over the 10 years period = 147: minimum at a time being 11, and the maximum being 44. FINGERS CROSSED!!!

just a quick shout out, from my friends experience, they all had straight forward application,i.e. no gap/ <absence allowance etc.
so I guess if any of you got straight forward cases then should expect a relatively faster decision this year. (if you submitted post-Jan 2010)

in my case,I have gaps,so more complicated i guess....

3 of my friend submitted their 10 yr ILR in January 10, recently got ILR granted/passport bk.seems like HO really speed up this time....

Waiting Times

Just a reminder when calculating waiting times to take Bank Holidays into account as UKBA will most definitely do this. Thus far we have had 3 BHs (including this Monday) and have a few more coming up.

For example, next Tuesday I would have been waiting 14 weeks 4 days (based on working days). But minus BHs, this would be 14 weeks 1 day.

Came to mind when I was planning my "attack" for when I start complaining. By the end of the 6 months some of us could lose a working week simply due to Bank Holidays. Just a thought.

hello everyone!! Just back from a holiday!!! YAY to the semi Freedom zone. coming thru immigrations for the 1st time with my ILR and as soon as they looked the pages of my passport, his response was oh so you live here. and with a huge grin on my face i replied YES!! (thinking to myself, living here the past 11yrs too). but the immigration officer went on to ask me on what basis, not sure if he was just nosy or was for his job!.... i responded Long Residence and he stamped my passport and i kept it moving!

So i wanna say a big congratulations to all those that have heard back good new, and goodluck to those waiting!

And Taylondon so sorry about the rejection after 6months wait. so so cruel pf them to keep u on hold like that. I wish you luck on your next application and i hope that your wait wont be as long

Irrespective of whichever party comes to power, applicants who submitted their applications before May 2010 may not be too affected as once the UKBA sends acknowledgment to these applicants (of having received these applicants applications), whichever party comes to power, it would be extremely difficult to introduce any new law that would effect applicants whose applications are already with the UKBA before 06th May 2010.

The reason, among other things, why I say this is 'coz Courts may step in if the incoming govt. introduces any new immigration rules with restrospective effect so at least applicants whose ILR applications are already lying with the UKBA (waiting to be processed) may, perhaps, not be affected even if there is any change in policy by the incoming govt. on immigration matters after 06th May.

What is there to say? "Still waiting, are you still waiting?" "Yup still waiting" Most of us know it's pointless contacting the UKBA for a progress update so we can't even discuss the progress.

The effect of a new government:

BNP - UKBA will be inundated with application withdraws
The Rest - sweet nada, initially. Though my personal opinion is that the existing applications will be "rushed through" to clear the backlog if there is a new immigration policy on the cards.
Hung Parliament - sweet nada for the foreseeable future.
