10 years long residence applications

hi everybody.....

havent been update myself last couple days! without passport, really drive me crazy: jobless, family past away, doldrums which diagnosed by GP which on the prescription of depression!

letters sent to Minister of border and immigration, MP, solicitor, croydon, sheffield, liverpool, FOI, none of them reply! helpless from them. really in the dillema situation. if withdraw an application soon, which wasted for 7 months wait and £820 plus other. if keep waiting, will have to keep continue in darkness with no timeframe provided. in fact, the ways they treated us are absolutely unacceptable. withhold someone passport long period of times, without provide any update or progress of an application.

i know as we all suffering for long wait, especially for those been waiting over six mths. i heard alot ppl wait over 1 year or 2.

inaccuracy of published service standards
ineffectiveness and ineffeciency of systems, policies, etc
not commitment in due date, without provide update or progress of an application, unless we can last until they decided either approved or refused. we have to continuosly keep in darkness, unless we willing to withdraw it. shame of them.

work can be done within couple hours previously in premier service, applied in post end up over six months and may take up to 2 years.

nobody will know what exactly they do. 7 months and 1 weeks, which long enough for waiting, i really do not know how longer i can wait, no idea what am i doing now, lost direction, motivation, pessimistic.

i am really appreciated for all of you whos have shares, supports, comments in this thread, at least you are not alone. we all aim for 1 purpose, so please do not bicker each other. keep update yourself. cheers.

I've read this new law change document which was posted on UKBA website today. but, I am finding it hard to grasp answers forsome of my questions?

1) what exactly do they have to do ? [new ILR or Citiznship applicants]
2) what is going to happen to Life in the Uk test ?
3) course ? how long ? another way to make money ???

No clue! Do you reckon they have like an initial screening system where they review applications and those that could obtain ILR go in a pile for further consideration and straight refusals get instant notification? It's the only thing I can think of if they are really using the FIFO system.

do we know anyone who waited for months and months and got refused ??

we really need a way to get the UKBA to explain how they process application.

Are applications left in a room untouched for 3-4 months?
Is there something that is holding up applications? if so what?
Can they justify why it takes them 6/7/8/9 months to complete an application?

Also, (a question to fellow members), how many applicants apply for 10 year residency each year?

That's the number of the Complaints department at Sheffield. I've tried a few times, but like you, have never been able to get through.

Would you guys stop this bickering..... We are all in the same boat right now and this forum is meant to offer some sort of support and solution, not a playground for unhelpful debate. We are all fraustrated and tired of waiting but as Foxy said, we do not have that much of a choice. You cannot compare the HSMP guys who took a class action. They were refused in there thousands on similar grounds by the HO which was what lead to the action.
We on the other hand are just anxious applicant waiting for decision from the HO. I am grateful to this forum for one thing, at least I know that I am not alone in the "waiting room"

According to info from some other forums, it would appear that at least two people who applied in September 2009 under 10 year ILR have already received their visas - they do not appear to have been special cases (ex premium etc. like Oluwa) either.

So I guess this blows all the other theories out of the water. Only UKBA really knows what it's doing. For all we know, they may well be assigning surnames starting with a letter to one caseworker - so the ones with surnames starting with Qs and Xs are bound to be the lucky ones because it's clearly not just one fair time-based queuing system they operate.

People who have applied after 1st of august 2009 will start their cases to be opened from 1st of april 2010 . It is said that there were so many cases pending cases of ilr to be given to those who had been waiting between 2 to 3 years , very complex cases ,,,,,,,,, they had to finish by dec 2009 but it could not be done so the time has to be extended till march end 2010. I think this is true as we have not heard any enquiry to the cases after 1st august 2009. as far as i know I know oluwa112 has got it as it was with the premium service people and the other guy got it according to him he used mp with a serious problem he was facing or something like that. our files are kept in a separate room locked up.if there was an enquiry anyone could have written in it and so on,,,

I have to say this does sound like a very plausible explanation. I heard about this huge backlog of asylum cases too and given that our applications are dealt with by the same unit, it's perfectly possible that all of our applications have been shelved and are being left untreated. I also know of nobody who has applied after 01/08/09 and received ILR.

I can only wish UKBA had been more transparent in this. If they knew (initially) that they would not be able to work on 10 year ILR cases until December 2009 at least (i.e. a 5 month wait by default for applicants from 01/08/09), they should have made this information public. I am sure a lot of us would have then gone via the premium service even though it may have taken a month or two to get an appointment. I know I would anyway. I only went postal because prior to August, one could see ILRs being resolved in around 2-4 months and I was happy with that timescale.

If they only start looking at applications on 01/04/10, then that's an 8 month wait by default for anyone who applied on 01/08/09. Unless they go through the 10 year ILR applications quickly, then it is perfectly possible that we're all looking at waits of between 9 months (best case scenario) to 1 year (more likely) or more (with some added pessimism thrown in). This isn't good.

I agree and disagree with you both.

Aman5, I appreciate your drive to try and sort out the injustice. You have my full support on that. Unfortunately money, time and experience may not be enough, as the HO are not bound by law to process applications by a time limit, legally they are not doing anything wrong. We may have a case under Human Rights. Unless we can get professional advise and actually find a piece of legislation which deems the act of the HO illegal, we have no leg to stand on. Before anything else, we need to find this angle if it exists.

Foxy, I share some of your skepticism. Its easy to talk now about going to courts, but the logistics of it when it comes down to it, may be unrealistic. Also like most other people, if and when I get my ILR, I'll update this forum and bid farewell best wishes to all, only to finally get on with life. Like you, I am not sure there is much we can do other than just wait (mostly because i am not sure we have a case).


Please let none of us bicker, insult or be sarcastic to each other. We are all under immense stress and not many people will understand what we are going though. I understand both of your points of views, but please lets conduct them in a more friendly manner.

I think you are giving yourself too much importance than it is necessarily due….What you like to see or not is irrelevant to the overall scheme of things….No one here needs to prove anything to you as the main priority is to tackle an issue which effects all of us.

I think the time we have spent to wait is too much and the money for which we had spent is of no use till now.I hope and pray to god all the cases should be open as soon as possible .

I have seen people getting ilr with a fake marriage and getting done in 2 months time , most of the hsmp make a self employed thing which they put from their account and get ilr , there are student who stayed 10 years but did not know what they studied in 10 years , I have seen student working 10 years fully working as a security service and at the end on december he applied for ilr in the premium service he got it . work permit also some people pay money from their pocket and give to the agent or to the company and get thier paper work sorted out ,,,,,,,,,,and get ilr ,,,,,,, there are so many things I have been seeing and hearing ,,,,,,cant believe ,,,,,,,,i have a friend he is a lawyer who has all these things been going on everyday but what home office does ? nothing they can do .............but people like us who has spent ten years legally and with hard working and with no criminal records no benefits and so on ,,,,,,at the end to be treated like this ,,,,,,, the home office time was 6 months and today 6 months is completed ,,,,,,,,,,

please note I did not meant to be saying wrong thing all about hsmp , work permit , fake student , marriage and so on ,,,,,,,on some cases there are fraud people who got it and genuine and nice people to suffer?

I am not really happy and what ever I have written above does not personally apply to anyone. I has seen these cases at my friends lawyer firm and I know lots of people doing here and there but never caught ,,,,,,,,I am not jealous or anything like that ,,,,,,,, but I am heartly sorry for each and everyone who is waiting for so long . I cannot get a sleep most of the times and wake up and feel like My head is going to burst , I had to send my wife because my visa expired on 28th february same time with me ,,,,,,,,,I did not apply for my wife as dependents are not allowed under long residency as i have been told and I read i t,,,,,,,,,

And what exactly will you achieve? What if the UKBA turn round and say the ILR 10 year privilege is to be withdrawn anyway? This used to be a concession only prior to 2003. Labour made it a rule and I very much doubt a Conservative government if elected would keep it. There are besides no specific provisions for it in the new rules to be implemented.

Anyway, I have said what I had on the subject - I will not respond to you anymore and with the attitude you display here, I do not feel any inclination towards joining you in your endeavours either, so I will withdraw my support. You cannot even be bothered to update your own status on the checklist but you will move heaven and earth for your ILR brothers in arms? Please.

'thms', I have applied in Feb. 2010 so perhaps have to wait for a few good weeks before I hear from UKBA.

Please allow me to once again reiterate which I said 2 days back 'we all are sailing in the same boat as far as this problem is concerned....so any discussion of a solution (to this problem) would be, at best, a joint effort'.

This is not just one individual's problem so if any buttons have to be pushed, it should not be 'if you think you can get a judge to push their buttons' but rather 'if we think we can get a judge to push their buttons in a matter of weeks'....

I hope all of you would agree when I say we all have to start thinking of this issue as a collective/joint issue as we all are in it together. This effects us ALL....

Please allow me to also state there are certain just causes in life worth standing for....so by a miracle even if I get my decision soon, my commitment to this cause would continue (until the day UKBA, hopefully, starts dealing with all 10 year ILR applications in, let's say, max. 3 months time) and not waiver simply owing to the fact that I have received my decision from UKBA....

Short of crystal ball analysis, I would be very interested in knowing how you came to such a startling conclusion? And even more puzzling, you first raise a query (‘would you still go on battling for others’?) and then also proceed to answer it on my behalf (‘I thought not’). Wow….in fact a double wow.

Pep talk is very easy, but we have to be realistic in this.

In this thread, I am at least trying to get people together to, hopefully, launch a joint concerted action in the Court of law….all you have done, so far, is (1) moan and groan and spread pessimism by your recent posts e.g. ‘there is pretty much nothing we can do’ etc. as well as (2) mostly indulged just in arm chair analysis and pass judgments on actions of others….so foxy my friend ‘ just plain talk and nothing else is even easier’ especially when done by just watching the action sitting on the sidelines….at least majority of us are trying to offer solutions and try to make things happen to get all of us out of this current imbroglio….sadly, the same cannot be said for the other minor few on this thread.
