You are correct. Baby is British, if born in the UK.

Hi,
There is no hard and fast rule of 28 days, it is a grey area, but there is no rule either that she can carry on with her old visa. Technically she is no longer of your dependent as you have changed your status. So this is a common sense approach, you should change her dependency to your status as a settle person and you are no longer on tier 1 that means she can't rely on that any more. Now, the question is what does asap means. There is no definition of ASAP, however ideally it should be within 28 days. But I think home office will also consider if your mrs apply late because of her family life and British citizen kids. My friend had to go to the tribunal for similar case like you because of the late application but eventually they got the visa. Therefore, though your mrs application will be successful even a late application but why should you get into all sorts of trouble if you could do it now without any question asked.
